    are the DWP made aware of his condition?

    TBH in my experience no one is excempt from ESA medical as those with terminal cancer have been called for PCA although when challenged have been told they no longer need to attend this happened to my aunt.

    in all aspects he would most likely receive an ESA50 questionaire, in wich you need to detail out the condition. this will be seen by atos then refured to the DM with advice for the DM on whether he needs more evidence or whether he wishes you to have a medical in a HOME SETTING quite possibly.
    Thanks for your help. The DWP know he has kidney failure because he normally gets a review form to fill in for his IB every 12-18 months and all his medical problems are listed on there along with a list of the various consultants he sees.

    This whole transferring over to ESA is very confusing, especially as he's been on IB for so long. We seem to be stuck in the old system, we don't even get child tax credit for our daughter because he gets money for her in with his benefits! We did get a letter about them changing us over onto CTC years ago but it's never happened yet and she leaves 6th form this summer anyway.

    The only reason I know about ESA is because I've read about it on here, we haven't received anything about it from DWP. We'll have to contact them once daughter leaves 6th form as she'll no longer be a dependent and they'll need to remove the money we get for her from his benefits, I wonder if they'll change him over to ESA then?

    I'm sure there's people out there on IB who don't use the internet and haven't got a clue that they're going to be transferred to ESA.

    rediculouse you werent entitled to CTC? what on earth, you need to be looking at that in a better more legal light, child element of IS IB was abolished years ago you dont get it with ESA either!

    did you apply regardless? if you were given false informatiom i would seek to claiom the 6 years from them in a court (why not too they d do it to us!)/

    I have come across someone (on a different site) asking this question recently. The opinion seemed to be that people on haemodialysis are automatically classed as having limited capacity for work (and thus the WRAG). Whilst they do not have to attend a medical, it might be in their favour to do so if they think they could be eligible for the Support Group.

    As you can see from my post I was called for a medical assessment when I shouldnt have been. After ringing the JCP office in Glasgow they confirmed that ATOS should have picked this up and I shouldnt have been called for a medical. They contacted ATOS and got the medical cancelled.

    I just got a letter the other day confirming I am in the Support Group.

    I'm even more confused now! :eek: I've just had a look at the latest letter we got from DWP with a breakdown of how they work our benefits out. It says on there:
    For a child aged 16 or over £62.33
    Because you have a child £17.40
    Amount £79.73

    This is then added to the amount it says the adults in the household need (me & OH). Then it lists the money we have coming in - my child benefit, my Carer's Allowance and my OH's Incapacity benefit. They then top up the amount we've got coming in with Income support so that it matches the amount "the law says you need to live on" (me, OH and daughter).

    As I understand it the maximum amount of benefits we can have is the amount "the law says you need to live on" so if I claimed CTC they would just take that amount off any income support top-up we get?

    I had a quick google and found this:
    Child tax credit has replaced dependent child additions for many benefits but if you were getting these benefits before CTC was introduced, you may still be getting the child additions.
    If you are on income support or income-based jobseeker's allowance and it includes child additions, these will eventually be replaced by CTC or, from 2013, you will be transferred to the new universal credit (which includes child additions).

    So as far as I can tell we're still receiving the dependant child additions because we were getting those benefits before CTC were introduced?

    Thanks for that, he would definitely attend a medical if they asked him to because, in my opinion, he should be in the support group because there's no way he can work, the kidney failure is just one of the things wrong with his health.

    to be honest i would be applying for tax credit. disclosed all info you have about the child elemant, and see what it comes back with?

    does he get long term sick/disabled elemant of IB? do you claim DLA?.

    seems to me that ATOS and the DWP will try and press anyone with any illness to a medical assessment,this is why sending important factual medical reports with ESA50 is key, because if they know before hand what illness you have and how it affects you and know that that condition is exempt from being face to face assessed the likely hood of being called for one is less. but that doesnt rule out you maybe wrongfully placed into WRAG or declined ESA and have to appeal or ask for a reconsidderation or documents ignored and called for a face to face with either the JCP or atos.

    it maybe worth going to a CAB benefit adviser to check over your entitlements to benefits and that your on the correct amounts to be sure.

    He gets long term IB (it was originally Invalidity Benefit then changed to Incapacity) and he did originally get an age addition too and also an addition for me and our daughter. Looking at the last letter we got from the DWP he actually gets £124.06 Incapacity Benefit so to be honest I haven't got a clue what additional elements he gets now. :o

    According to the letter the law says we need £257.78 to live on. We get OH's IB £124.06, Child Benefit £20.30 and my Carer's Allowance £58.45. This comes to £202.81 so Income Support top our money up with £54.97. Surely we wouldn't get any more money if I applied for CTC?

    My OH also gets DLA high rate mobility and middle rate care.

    We've lived on benefits for about 18 years now due to OH's health and we've always informed them of any changes, for example as soon as I was awarded Carers Allowance we told them and they reduced the money my OH gets, so I've always just assumed the DWP have got their figures correct. :o But it's been very confusing because he was originally on Invalidity benefit then they changed it to Incapacity Benefit then they brought in CTC and now they're changing over to ESA!
