  • All I will say is, you are watched from before you enter the building.

    And what happens in a medical is, you explain your condition, day to day life, they hear blah blah blah, and write down what ever the hell they want. Even if it is recorded. (which you should call and request in advance, as they now do it) it can prove to be an invaluable piece of evidence in showing that these charlatans don't do their job correctly.

    I don't mean to worry you, but it is better to prepare for the worst with these people.

    All of my partners benefits were stopped, he i now suffering with acute anxiety, all because the medical 'professional' at atos lied. we are appealing the decision, and have a catalogue of medical evidence to prove she is wrong, but we shouldn't have been put in this situation at all.

    Just rang up and they told me you have to still keep providing sick notes and I have requested a medical report.

    You should not have to keep submitting sick notes, once you have recieved official notification of the decision. However it is better to do that, to be on the safe side, if you have been told to do so.

    The medical report should give some indication of when you can expect to be re-assessed.

    Hi wigarnl

    You should not have been asked to continue submitting sick / fit notes. The person you spoke to didn't know what he / she was talking about and was guessing at the answer.

    Though as HB58 says, best to keep submitting them though if it is needed.

    I suggest phoning back and speaking to another person. You'll probably be told something else.

    The whole thing sounds like an absolute nightmare and I must admit I'm dreading the time when my OH is transferred from IB to ESA. Although he has one of the exempt conditions so am I right in thinking he won't have a medical and will be classed as having "limited capability" for work?

    depends on what you mean by exempt conditions?

    was he classed as exempt from another medical, or does he have a condition that is a descriptor from having to attend?

    if he attended a IB assessment put in a exempt catagory by the assessor then yes he will be subject to another medical as inpart ESA is a different benefit with different descriptors.

    He has chronic kidney failure and has dialysis in hospital three times a week, as I understand it haemodialysis is one of the exemptions so that means he will be classed as having limited capability for work? I'm not sure if he'll still have to have a medical or not? His last medical for IB was about 10 years ago and he didn't have kidney failure then, he has been having dialysis for the last 4 years.

    are the DWP made aware of his condition?

    TBH in my experience no one is excempt from ESA medical as those with terminal cancer have been called for PCA although when challenged have been told they no longer need to attend this happened to my aunt.

    in all aspects he would most likely receive an ESA50 questionaire, in wich you need to detail out the condition. this will be seen by atos then refured to the DM with advice for the DM on whether he needs more evidence or whether he wishes you to have a medical in a HOME SETTING quite possibly.
