    Hiya, I am with Airdrie Savings Bank, Whifflet, (charges - £2070). I have had confirmation from them saying they have received my 2nd letter "and will revert to me in due course" that was 25.4.07. I feel physically sick and so frightened at the thought of the next steps. I don't know what to do now that the 14 days is almost here. A friend of mine received a cheque from them for her charges, they had sent a letter saying they were closing her account, she went to CAB who told her they can't do that, they dealt with it and she received a cheque through the post.

    hi katcris, i ended up having to take them to small claims court - hearing date was 3/5/07. ON the 10 april i receive a cheque for £705.00 which was what i was claiming for. Still owe me another £1500.00 so going back to small claims again. Don't be scared its easy.

    I feel a little less frightened now that i have found others dealing with asb. If i receive a letter back refusing to pay out does that mean i will have to make 3 seperate claims to the small claims court? If so how do i go about it and do i have to attend court? The letter i sent them was asking for the total amount to be repayed (£2070) should i have sent seperated letters to them claiming £750 at a time?

    You can only claim up to £750.00 per claim, so you will have to do 3 seperate claims. Go to small claims court and get forms 1 and 1b. You pay them a fee for £39. You will have to list on a seperate sheet every charge and the date of charge and attach that to form 1b. There is no chance you will go to court they willl pay before the date of hearin, there is no bank in the country thats taken it to court. I sent them a letter asking for £2070.00 so its ok you did the right thing cos you have let them no that you want it all back not just £750.00. Well go for it .... you will get it all back!

    I have now received a reply from ASB saying that in view of the OFT investiagtion the ASB consider their charges to be fair and reasonable and in most cases lower than their competitors and have advised me they are unable to agree to my request for a refund of £2070 of charges in the past 5 years. However the bank will review once the OFT publish their findings. I can understand why some people now drop out at this stage, should i continue with court proceedings our do i wait for OFT to publish their findings??????

    If you have sent the letter threatening court then this is your next stage however in view of the amount of money you are claiming you would do better to pass your case over to the Financial Ombudsman.

    I haven't sent the letter threatening court yet, do I go ahead with this before I pass my case over to the Financial Ombudsman?

    Hi Katcriss, I am with a different bank, but phoned the FOS to ask if I could send the letter threatening court action and they advised this was ok, as long as I actually didn't take the action before handing my claim over to them. Izzy
