I Wrote About This A Few Weeks Ago.
Virgin Still Have Not Sent A Bill, They Said They Would Inform The Debt Agency Of This But They Have Not Done So.
I Am Getting Letters From The Debt People Saying A Court Judgement Will Be Taken And I Will Have To Pay All Legal Costs And My Name Will Be Entered Onto A Defaulters List Even If I Pay It After The Court Action.
But Virgin Have Never Produced A Bill For 7 Months, They Acknowledge They Have A Problem, But Have Not Done Anything About It.
1. Where Do I Stand With This?
2. What Will Happen If It Goes To Court And They Cannot Produce A Bill?
3. If Thay Do Finally Produce A Bill Or Generate Something That Is Typed Up In Excel, Would I Have To Pay For It?
4. If They Do Have A Bill, Would I Not Be Liable For Legal Costs As I Have Not Avoided Virgin For The Whole Of This Period?
5. If I Pay For It, How Do I Get My Name Of The Default List, As I Was Never In The Wrong?

Firstly, I would take what the debt collectors say with a pinch of salt...
The onus in any court case will be for Virgin/ their agents to prove that you owe the money.
Firstly, you say that they acknowledge they have some kind of problem, have you been able to get this in writing, fax or e-mail form? If so, I would suggest you retain this to give to the judge/sheriff should it be required at a later date. Any other correspondence would also be useful.
As for the legal costs, it is likely to be on a small claims basis, so any potential costs are limited, plus the judge/sheriff does have a certain amount of discretion, and would be unlikely to award costs when Virgin have caused this situation themselves.
I would find the most senior person within Virgin mobile you can find and send him/her a letter and copy in any evidence that you can find regarding their problems. Also, raise a complaint with OFCOM and look into OTELO. All this will set you in good stead should it go to court, as the judge/sheriff will see that your not simply trying to avoid paying. However, if you kick up more of fuss at this stage, I think you might find that it gets sortd out.
