Hi
Can anyone advise the first procedures of trying to claim unfair charges on both credit cards and bank charges please, i have a capital one master card & vanquis visa card which is both actually open with balances on both...
Also citibank account is now closed last month and over the last 5 years they have taken £4270 in bank charges of £25 a time. Im asking can some one advise on what to do and which template letters to send to the above mentioned etc ???
All help will be highly appreciated.

The banks won the court case on unfair charges and now any complaint about bank charges made on that basis are automatically rejected. The FOS will not consider them either. That boat has sailed. Only hardship cases and first time offenders tend to get refunds nowadays and both are at the goodwill of the bank.
Credit cards still have some scope. If you charges are over £12 per go then you have quite an easy job. If they are £12 or under then its harder but some still report success.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. Hello,
You may well be able to get charges back, plus interest, even those of £12,
how much resistance the banks put up varies, there are templates online, and useful resources on the link mentioned. Basically you will be saying something like the following.
That applying late fees and over credit limit charges are unlawful at common Law, Statute and recent consumer regulations. Draw their attention that the terms of the contract which they agreed to at the time, it is an implied term of that contract that they would conduct themselves lawfully and in a manner which complies with UK law. And request all charges plus interest within 14 days.

I don't recall bank charges being ruled unlawful? Which presumably is why they are still making charges despite having been taken to court0 -
Hello,
the information I gave is in relation to credit card charges, bank charges are not as easy.
Credit card charges are refundable, they still put them on, but sending a simple letter requesting charges back + Interest will work most of the time, as they know they are in the wrong.0 -
as they know they are in the wrong.
More likely that its cheaper to refund than fight it when the amounts are small.the information I gave is in relation to credit card charges
What law is it that you are referring to with credit card charges?I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. Hi all
Reply from citibank regarding the hardship case, they have refused to refund any monies at all stating the banks won the court rights in July 2007 (OFT) and the supreme court favoured the banks in november 2009, but CITIBANK would like to assist me to take advice from CCCS to help with my hardship issues ( no thanks),
2nd letter going off tomorrow and then ill take it to the FOS i suppose....:(
thanks0 -

Hi howie,
for vanquis i just sent a data protection request (without the £10 fee!!!) for deteails on my charges and within a week they sent me a letter with an offer and a choice to close my account or pay a £25 per year fee on the card. The offer was around what i was owed so i accepted it but 2 months on i still have not received the cheque so i have had to sent another letter to try and speed them up.
Capital 1 only offered me the difference between the £12 and what they charged, the amount cleared my account so i took it.
Also i see you are going to try and claim PPI back from HFC, i done this a couple of years back (near the start of the PPI scandal) and although it took a while they refunded. They were the worst at the hard sell and lying through their teeth to get you to take it, i was actually told that i couldn't have the loan unless i took the PPI.
Hope this is of help
