moorcroft debt recovery

I recieved a letter from Moorcroft debt recovery saying i owed Barclycard £1800, i sent the letter back because i have never had a credit card with Barclays. Today about a week later a Baliff came to my door about the same debt and i told him the same, his responce was they all say that. By going on this site i now see that an Egg card i had with my late Wife which i thought i had payed off aws not and has been passed to Moorcroft. To be honest i have just about enough in the bank to pay this but it would leave me with nothing for emergencies. My only income is from DLA and incapacity Benifit, i would be able to pay a monthly amount but what is the best way of starting this as most people on here say do get into conversation with Moorcroft as they will browbeat you, can anyone help or advice John.

    The only way a bailiff would come to your door is if it has gone to court and there is a judgement against you, sign up to credit reference site free for the first month to see if there is anything on there about this. This sounds like debt collectors, moorcroft are not bailiffs as far as i can see, do not confuse debt collectors with bailiffs , they are very different. Without court orders they can only request payment and that is it!

    Hi Sapnuwuf,

    Sorry to hear about your wife, but surely Egg must have written to you regarding this matter or was it overlooked (I am not judging, its just that I have experience with Moorcroft, and not a pleasant one, at one stage they were sending me two/three letters a week. I am surprised they have sent a bailiff round so soon without sending you a barrage of mail first as taffy056 said probably their debt collectors).

    I obviously don't know the ins/outs of your situation, but was it your card or a joint? How long has this debt been due for? (over 6 years it becomes statue barred)

    Might be worth offering a full and final settlement on the account if it has gone down that route.

    You are entitled to breathing space and creditors are supposed to respond sympathetically to any problems you have, perhaps it would be best if you get in touch with CCCS or the national debtline, they will give you impartial free advice.

    As well as a debt maybe being statute barred if you have not acknowledged a debt for 6 years, you can send moorcroft a CCA Request , a template of this letter is on the link below, they must reply within 12 days with proof that this debt is owed. Also on the link is a letter to stop further door stop visits and phone calls.

    He came to my door asked me my name and said i,m a bailif and ive been sent by moorcroft. the account was in my name only, but was not used very much and only minimum payments paid every month. When my Wife died everything went to pot because she dealt with everything financial, The card only had a spend limmit of £750 and yet they say i owe £1800 how do i offer to pay them a monthley sum and stop them hasseling me? My Wife died in 2009 so i dont think the card will have been used since then, i dont even know where it is a lot of things were torn up and thrown away. your replies and help is much apprciated John.

    Have you checked to see if there are CCJs in your name ? Without going to court he is not acting as a bailiff, he would be basically lying to you ! Did you leave this person into your house at all ? Is this card in your name as well as your wife's ?

    If he actually used the word "Bailiff" then when he comes back, ask to see the identification that confirms he's a bailiff. If he can't produce that tell him that you're not going to deal with him, that you know he's got no "powers" in himself, and that you'll only deal with his employer in writing, and that your first letter will include a formal complaint about how he misrepresented himself.

    This will get you some peace and quiet at home and you'll hopefully feel better for having taken some control of the proceedings too.

    I would ask for a breakdown in charges. I suspect that that they've added quite a few interest and late payment fees to this account. Some of these would (arguably) be reasonable but that does seem like a big increase.

    Remember these things
    • Deal with them in writing only
    • You can only pay what you can afford.
    • Unless they're real bailiffs from the courts, their "debt collectors" have no rights to be on your property if you don't want them there, let alone to harass you at your doorstep, etc.
    • If they were to take you to court, the court would only order you to pay what they think you can reasonably afford. And the court will very likely be more "reasonable" than moorcroft.
    If you don't stand for something, you'll fall for anything

    Thanyou so much for all your replies, i tried to get afree trial to check my credit rating and see if i have any ccjs but they all want card details and do not have a credit card now and am bothered they wont cancel it after the trial period, So should i wait till moorcroft contact me again, and make an offer to pay a monthley amount i can afford do you think £10 a month would satisfy them?

    As suggested, send a CCA request.
    Also, send a prove it letter and don't pay them a bean until you get back to us.

    Also, as suggested request a full breakdown of charges and a copy of the legislation upon which they rely to charge it. Don't trust these fools one bit..

    Edit the below to suit..

    Dear Sir/Madam

    Ref: xxxxxxxxxxx

    You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

    We would point out that we have no knowledge of any such debt being owed to The Loan Company.

    We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    We look forward to your reply.

  • i had a visit last night my other half went to the door when the man started banging the childrens bedroom
    window. he said he was from morrcroft but would now tell him anything else can they do this
