    This can be a very grey area and will vary from area to area.

    The general definition of a goods vehicle is a vehicle constructed or adapted specifically to carry goods. Lets face it, about 95% of modern cars can fall into this category if the rear seats can be folded down, especially if they are an estate car. But, the reason to restrict certain loading bays to 'goods vehicles' is because a lot of goods vehicle are too large to park anywhere else. So if a car is in the loading bay and a goods vehicle arrives, what does the goods vehicle do?

    I think eventually with the increase in successful appeals (as highlighted above), all that will happen is that TMO's will get amended accordingly where the definition will be more specific.

  • Thanks vax and coupon, states petrol car but will check tax disc in morning. As for ripped, BRILLAINT, finding case law like that is priceless. I will be appealing this as feel a lot better now. Thank you.
  • Just to add a bit more, the bay in question can just about fit a sprinter. And its off a main road that no HGV could easily go. Will go there over the weekend and retake photos. Thanks again all.

    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Good news and BAD.
    Good news, WON the appeal on a technical error on the point of the council not detailing the first notice in the right way.They forgot to point out it was a goods loading bay. They referred only to my vehicle not being suitable. My appeal contained the words"I assume it was a loading bay" as I cannot remember due to the notice being a camera car.
    Bad news is, LONDON Adjudicators will not follow rulings from other districts, like warrington vs hart council. It is to big a business. Their view is that a car is a car and not a goods vehicle. Personally, I think I won so as not to make the Adjudicator be the first to rule on the car argument. I am taking this further,as I have business insurance for my estate car and as such, I believe it is a tool of my trade.
    But a big thanks to everyone who posted here as your posts have really opened my eyes to the problems we motorists face daily together. I just did the leg work and you all won it together, a very BIG THANKS again.
