hi, i'm trying to organise a claim against our PPI, and just need a bit of help. when we renewed our mortgage, we went through a financial advisor that we'd gone to before. it was the financial advisor that organised everything including the PPI for the mortage without mentioning that because i work for the NHS, that it wasnt really necessary. who do i claim from that i was missold the PPI; the mortgage company or the financial advisor? ta for any help.

The adviser is liable for the advice given. You complain to them. However, be aware that if this was before 2005, then there is a good chance your complaint will not have to be considered (not all advisers but most only became regulated in 2005).

Wrote to GE Money who the loan was with, but they said it was the firm that mis-sold the PPI and they are no longer trading and to find out who the administrators are to put our claim to, how on earth do we go about this and is there going to be anything left for us to claim from or should we just give up?

Hi. I have had exactly the same problem, but it was when they were 'First National Bank', GE Money bought them out. They have told me it was done through a third party and it is them that I need to see about it. But the company are no longer trading. Catch 22!

I replied on the above post about GE Money.

I have just been told today from a PPI miss-sell company, that as GE Money were not registered until 2006, (I took the loan out in 2004) they wouldn't be able to do a claim for me. Is this correct?
  • Hi all
I am needing some help and advice i had a capital one credit card on which the balance was paid and card closed on the 25th January 2007, using the template provided i have written to capital one requesting my original credit agreement and they have replied saying that due to their being no balance owed to them the obligation to provide documentation under section 78 of the consumer credit act 1974 does not apply, im am unsure as to what steps i can take now as i am certain i had ppi on this credit card which i would never have agreed to take out.
I would be grateful for any help

    Thanks Samantha

    Correct.

It is not the lender or the product you are complaining about. It is how it was sold to you or set up by the seller. If the seller no longer exist and they were not covered by an appropriate body pre-regulation then if they no longer exist there is no-one to complain to.

You sent the wrong letter. The £1 request under the CCA only applies to debts outstanding. you dont need your agreement to make a complaint. Just make it.

There is nothing wrong about having PPI. Just having it is not grounds for complaint. The complaints are in relation to how it was sold, advice given (if wrong) or how it was set up (e.g. single premium added to loan instead of monthly). So, even if you use the correct method (data subject access request costing £10) and they tell you that you have PPI, you still need to have reasons for complaint.

Hi all, I had a loan ten years ago and paid it off just over three years ago. It was with alliance+ Leicester now Santander. I am afraid to say I threw all paperwork away many moons ago but undetered I wrote to Santander with what info I could give them as I believe I was mid sold Ppi . I have received a letter in response from them stating
Unable to locate account based on information provided. As I said I have no info except I paid money to a+l from my bank (Halifax) in 2008. The loan was paid into Barclays when I took it out but in branch couldn't provide any information that old. So the main question is how do I get the loan account number? Any other help would be greatful

I contacted my lender (HSBC) at the beginning of December using the template provided to ask them for a copy of my T&C's (and included the £1 cheque).

I have not heard anything back from them and it has been almost 12 weeks.

What should I do now (if anything)? Thanks

I have the same question. If I jsut go ahead and make a claim I have almost no details to do it with. I sent the letter asking for details of my T&Cs nearly 6 weeks ago. What do I do now?
  • Please could anyone help with a mppi question?. We have been paying £32/month for 10years for mppi. We felt that at the time we needed to take out what insurances they advised us too (we were quite young and it was our first mortgage) and we were also told we need life insurance with critical care cover and income protection. On speaking to our bank manager yesterday at HSBC, he also was unsure of why we should have Mppi and income protection as income protection will pay the mortgage if we are unable to work. He advised us to look into this further. Any advice would be greatly appreciated as we are a bit confused!
