Hi all,
Hoping someone can help, I've started my reclaim with Capital One and they've responded to me initially claiming their records indicate the PPI was sold to me over the phone - but they are conveniently unable to locate the recording of this call. I was never in any need what so ever for PPI and I know for a fact I never agreed to have it added to my account so it was without doubt mis-sold.
Nothing on the MSE article seems to give me a follow up to this feedback, so before I reinvent the wheel and try to poorly word my response I wondered if anyone else had come across this and had a decent message?

Hi, I have just Martin Lewis on This Morning talking about PPI. I have previously sent in a claim over 5yrs ago which was rejected by the Nationwide Building Society and I appealed to the Ombudsman but it was rejected by them. We were sold PPI with our Mortgage in 2005 and was told we had to have PPI even though we said we didn't want it. In 2009 I had a baby and became a stay at home mum so amended our PPI claim and so from 2009 it wasn't missold as we wanted it as an extra insurance due to husband job being insecure. We only claimed for 2005-2009 but still were rejected. Martin mentioned if the commission claimed by the bank was over a certain amount we could claim. Can I still claim again even though it has been rejected before? Where can you find out how much commission was charged? Are there companies that can find out if you have PPI on loans as no paperwork anymore? TIA0

I am so confused! I had a joint mortgage with my ex husband for about 10 years 20 years ago. He bought me out as part of the divorce settlement. Would I be entitled to make a claim on that period? Also, there may be a bit of an issue with paperwork as I have nothing and my recollection of when it was running is a bit vague, all I know is the bank/building society it was with.0

Quite normal. Most of Cap One PPi sales were over the phone. Most were not recorded or past the point the recording was retained. The FOS know their script and have no issue with it as long as the person was eligible.I was never in any need what so ever for PPI and I know for a fact I never agreed to have it added to my account so it was without doubt mis-sold.
So, why didnt you complain when you started paying it?
Your complaint is weak and the longer the gap between you starting paying PPI and you complaining, the less credibility you have your complaint. i.e. complain in the first few months of paying it and you are credible even if there is no evidence of wrongdoing. Yours is one of the weakest complaint reasons. If you have no evidence based failure (eligibility, pre-existing conditions etc) then you are largely reliant on either another failure occurring or an auto-payout. If the commission was over 50% and your complaint was rejected, then the firm should refund the excess over 50%. i.e. if the commission was 60%, then they should refund 10% of the PPI premium. Loan PPI was typically very high. Some as high as 90%. However, MPPI was typically in the 25-35% range. Some more, some less. It is not expected that most MPPI will be captured under this new ruling.

Hi, I am wondering if someone can advise me further as Lloyds have left me a little bit confused.
I went through some old bank statements and found references to PPI on my credit card. I made contact with Lloyds online requesting for more information as to about what accounts and for how long I had PPI. I received a response in the post. One letter was entitled about your PPI Complaint (which I never made) and the second was about DSAR. I phoned Lloyds to advise them that I hadn't made a complaint as yet and wanted to find out more information about PPI on my accounts. I was advised that I needed to follow the DSAR letter. I did this enclosing the required cheque for £10 stating also that I would like all the information about PPI / PPC and what accounts I had them on. 3 weeks later I received a letter and an offer of £500 advising that I don't need to do anything further and they will send me a cheque. Is this PPI Compensation or a settlement so that I don't take it any further? The letter also doesn't really give me much detail so I am not sure what I paid £10 for. If this is a settlement then how do I progress with my claim in the normal way?0 -
What did the letter say it was a settlement for? Looks like they autopaid you.
They interpreted your request for accounts had PPI on as a PPI complaint [ not unusual. since you were planning on doing this yes?] and investigated and paid you some money for your 'complaint'

Any claim put in would require both signatures and any redress split 50/50.
If your ex was the first named on the policy then he would need to make the claim and would get the payout 100%, this is all irrelevant though as the MPPI was most likely not mis sold and you have no paperwork.0 -

The £10 is for a copy of all the data they hold on you (DSAR), they have assumed you were going to complain and as the amount you paid is so low they have just paid out without fighting. You should get a breakdown of the amount with the chequeSam Vimes' Boots Theory of Socioeconomic Unfairness:
