PPI Reclaiming Discussion Part 5

Hello,
Can I just ask a quick question.
Where do I stand if I claimed when I was made redundant, so was getting my loan paid for?
I assume I cannot then claim it was mis-sold, regardless of whether I wanted it or not when taking out the loan ?
Thanks
Frosty
You claimed on it so you can't argue you didn't know about it or that it was unsuitable. Even if they did agree it was miss-sold for some reason, they can deduct your payout from any refund. Arguing that you didn't want it and that you should be put in a position as if you hadn't paid it would logically mean paying them back the money you claimed after losing your job...Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Your only chance with this would be a DSAR (cost you £10) to the bank to see what records they have left - front line staff may not be able to see old closed accounts. Bear in mind it may well be too late for you as banks tend to start deleting records 6 years after the account was closed and if nothing is left, your complaint is over and you would lose £10.Sam Vimes' Boots Theory of Socioeconomic Unfairness:

CAN ANYONE HELP?
If you can please PM me.
Long story short my financial background was tainted badly when I was at university and had endless amounts of credit cards and eventually loans to pay them off.
I can recall having an Intelligent Finance and Barclaycard credit cards that I paid PPI on and also 2 loans through Bank of Scotland that I was told the usual "you'll be accepted if you take the protection" and being a naive 20 year old you agree as you want the money.
I've put it off but I can't remember any details and these date back to 2001. Has anyone based in Scotland used any of these PPI firms local to Dundee that are any good and/or is it easy to do it yourself when you don't have any details?
I'd rather let someone else do the leg work and take a cut than spend hours and hours trying to find details myself plus I've moved house twice since the start in 2001.
Thanks in advance for any help.0 -
It is now three years since I made my PPI complaint.
UPDATE -
I recently received an update letter from the FOS regarding my two tier complaint with two catalogue companies. I have been told that as the Policy was sold to me in January 2006 during a telephone conversation, and as I did not make the complaint until March 2012, my complaint falls outside the six year element of the rule, and so is time lapsed, however, they are considering my complaint under the three year element of the rule, as I made my complaint in 2012.
Information concerning cancellation of the PPI policy, which the company say they sent me, in 2007 and which I did not receive, has been deemed insufficient to make me aware that there might have been a problem with the Policy, and so the FOS say that because of this, they can now consider my complaint.
The FOS have been wonderful, keeping me informed of their progress with this case, but we are now at the stage where I have been told that it's anybody's guess as to how long it will take from here. I was told it could be six weeks or six months, a year...Rumble...Rumble...:(0 -
I wonder if anyone can help me. I received a letter (13/04/15) from Santander re: the PPI on an old Debenhams store card account. I paid off the card in 2005 and made an original PPI claim in Oct 2007 to GE Capital. This was refused but I didn't go any further (Silly me!) Now Santander contact me 8 years later saying that they have been told by the FCA in 2010 to look into historic PPI cases and I am being asked for information on the account. I have not had an account since 2005 - had a bit of money back from it in 2008 for fees I had claimed, but that was it. I had the card since the mid 1990s and had CCP PPI at the beginning but cancelled it part of the way through having the card as I realised I didn't need it and I would not be covered anyway but I do not have the CCP PPI number, start date, end date any more as it is probably over 15 years since I cancelled the PPI. I also do not have the start date of my Debenhams card (again 15-20 years ago). As most of the information is way over 7 years old, is there any way I can get this information 15-20 years later as they are asking for this information?0

Sorry I don't understand what you mean - do you mean you made a claim on your PPI and now want to say it was miss-sold i.e. you shouldn't have had it and that they shouldn't have paid you the £2500?
Yes you can complain it was miss-sold but expect a very robust defence as you knew about it and it was suitable for you - plus the £2500 claim will be taken off any miss-sale refund.Sam Vimes' Boots Theory of Socioeconomic Unfairness:
