Fergie - I was in exactly the same position at the weekend and I too got a refund. Although this was with payday express.

Some users on here are so quick to judge - people post on here for genuine advice and they shoot you down and try and take the moral highground. I doubt very much that any of them have never defaulted on a loan and are completely debtfree. it's funny, I got the same kind of replies on my post about my situation and whats even funnier is that many of them were the same users that's have replied unhelpfully on yours. They clearly have nothing better to do than sit at a computer passing judgement and patronising people who have a few money problems - I'd rather be in debt than to live my life on he Internet trying to make people feel bad about something they have done to get by.

So sorry to hear about your Husband Fergie, I too know what a tough time you are going through xx

You did miss the initial contractual payment: some two or four weeks after you had received the money. After all it was a short-term Payday Loan, not a loan to run for several months/years.

That means, you have defaulted on the original agreement.

As I mentioned in my first post - you need to look at what the original agreement says at the point when you took out the loan - please share that with us. Did you pay according to that schedule ?

I get the feeling this thread could go on for ever because the OP doesn't understand what it actually means to default. I don't mean be issued a default but default on the ORIGINAL agreement on what to repay and when.

I would imagine that your credit record will be marked as such but if you're having to resort to Money Shop for loans, that shouldn't be an issue for you.

Fergie - glad that it is all settling down again now. But may I make a suggestion? As I understand it you are paying back the money each month by debit card - is this correct? To ensure that several months down the line, that a similar situation does not occur, ask your bank for a NEW debit card, with a new number, and arrange to make the remaining payments by direct debit - you have control over the amount that goes from your bank each month that way!

No KingElvis my credit record was not marked with a default because I didn't beeping default. As I've mentioned several times now I was ringing them about the payment date and they instigated the new payments. As for resorting to PDL's I don't even want to go there with you as to what that was for as you would probably say it turned out to be a waste of money!
thanks for the advice thorsoak I have taken that on board already

Sadly you haven't provided us with the answers to questions that will nail this once and for all - what did the original agreement say about repayments - what were the contractual payments supposed to be ? You still seem to be confusing an arrangement to pay (at a reduced or altered amount) with your contractual payment.

Also thorsoaks advice won't work - sorry.

Why not? My bank advised me to do this when I was caught in a "scam" which meant that I had (inadvertantly) given my Debit card no over to a company which could then take payments from my current account ad lib!

Ignorant bank employee then - literally hundreds of posts on here where that approach has failed.
