Bill of Rights 1689. Section 2.12 specifically states “That all Grants and Promises of Fines and Forfeitures of particular persons before Conviction are illegal and void.”.

What i would suggest is for people to research The Bill of Rights.

That is the top trump for a lot of things, even council parking tickets.

It has been used with my local council for 4 parking tickets and not a word back from them for a month. A council ticket was put on a car 4 times and within three days the council got the tickets back with a nicely worded letter and nothing has been heard from them and they don't normally give up.

What the vast majority of people do not realise is that "fines" issued by councils like a dog warden and come to that even police officers "on the spot fines" are totally illegal.

Do your research.

Trust me, PPC's don't trump Parliament with any of the total and utter crap they come out with.

As Give Them FA says, use the law against them and sue.

I am going to deliberatley go out and get a PPC ticket and I WILL respond to them to tell them to desist with their futile letters and if they don't, they are going to get sue'd.

Their lying, conning and extortion is coming to an end.

A senior appeal judge has already ruled that parking tickets are not fines, they are penalties and payment is optional ??
So in response the councils employ big nasty bully boy bailiffs to stick on hundreds of pounds in charges, seize vehicles, drive them or lift them to an auction in Osset wakefield, loose the keys if they have them , WOOPS or just take it with none so it sells for no more than the bailiff charges and ticket and teach the dity public a lesson in who owns your backside !

Anyone who has had their car seized, look on CW harrisons website, buy it back for a few quid, you will already have the keys.

Council's changed the name to Parking Charge Notice, it may not be a fine but it is a forfeiture, still invalid.

You CAN use the law against the council and whats more it works.

As you say, you are never beaten till you admit it !

I take it you are also familiar with McCarthy v Stone - the case which established the principle that there can be no taxation without statutory authority, such as the Road Traffic Offenders Act 1988, which provides for fixed penalty notices.

As much as I'd love to see someone succeed in relying on such a founding piece of legislation I highly doubt it would stand up given the fountain of legislation and common law since 1689.

It's Penalty Charge notice and they are not a fine or a forfeiture as a judge has ruled they are optional and separate from the administration charges levied recovering the civil debt, this combined with the fact that the council own the court who will issue the orders.
The notion that a serf can use the Law to his advantage against authority is best reserved to the sixth form.
Google what happens to people who think they can, Norman scarth (severely beaten 85 yr old man) , Paddy kirk (sent to mental asylum for challenging a judge on the law, escaped was given political asylum in France !).

The Bill of Rights is a "constitutional statue" and may not be repealed impliedly by the Road Traffic Regulation Act 1984, Road Traffic Act 1991, Traffic Management Act 2004, etc. As stated in the "Metric Martyrs" Judgment in the Divisional Court (18th February 2002) by Lord Justice Laws and Mr. Justice, a copy of the judgment's relevant sections 62 and 63 are below:

62. "We should recognise a hierarchy of Acts of Parliament: as it were "ordinary" statutes and "constitutional statutes." The special status of constitutional statutes follows the special status of constitutional rights. Examples are the . . . Bill of Rights 1689 . . ."
63. "Ordinary statutes may be impliedly repealed. Constitutional statutes may not . . ."


Nothing trumps The Bill of Rights 1689.

Ha ha, I would like it to be so! But while in theory the judiciary is independent of the executive, you know how far "in theory" gets you!

Doesn't stop us suing PPCs though!!

And, in practice, if you know the law and are smart, one of the Council's bailiffs will never collect a PCN off you. Thousand upon thousand go unpaid.

I would research that maurice kirk bloke, he had them bang to rights using the law and the judgement would have been made in his favour as he had cornered them, they had him sectioned in the nut house, he escaped by bribing a doctor, fled to France and was granted political asylum.

Google searches on Paddy Kirk only seem to come up with a character in Emmerdale. Do you have any more info Vax?
