Can you cancel a phone contract if you’re not happy with the service you’re getting?

Hi,
I’ve had my contract now for 12 months, or thereabouts. It’s a Blackberry Torch.

Now, the first few months I had no problems what so ever.

However, over the past 5 or so months, I’ve constantly had poor signal, I’ve had my texts not being sent or not coming through, poor access to the internet and not receiving or not being able to send emails etc.

I pay £45plus per month to have 3GS signal, unlimited texts, internet and 600 minutes.

I’m growing fed up and quite angry at the lack of signal I get on my phone.

I know there is nothing wrong with my area or the individual settings on my phone, as I said it was fine in the first few months.

Surely if I’m not getting the service I’m paying for then I have some cause of action? At best I should be able to cancel my contract, although I guess this is very unlikely.

If I didn’t fulfil my part, i.e not paying vodfone would kick up a fuss, cut me off my line etc. So why should it be different when they’re not fulfilling they’re part.

They can not be exempt from contract law?

    The signal is 3g, not 3gs.
    Not being happy with the service definitely is not a sufficient reason for cancellation. Generally, you can complain and demand cancellation if the poor signal is a result of some changes implemented by vodafone after the contract started, like, say, switching off a mast nearby.
    Are you sure it's the signal, not the handset? Is it at home only? If so, you can ask for "Sure Signal" box: No signal coverage on new Vodafone contract

    You would have to prove that Vodafone are not supplying the service to you with reasonable care and skill. See Section 13 of the Supply of Goods and Services Act 1982.

    If the issues are indoors you'll get very little traction as no network guarantees coverage indoors, but the nature of a radio based systems means there will always be some low reception area's.
  • From a carrier point of view, it would open a can of worms for all those punters who enter into a contract and then can't be bothered honouring the full term. Not saying this is your case OP, but there are plenty of them in Broken Britain. Makes it twice as difficult for those with a genuine grievance.
  • Thanks for the replies, just to clarify, my signal goes from a full 3GS, to SOS in apparent random places at random times.

    I.e I have been at work from 9-5.

    I woke up this morning, it was fine, full 3GS. Got to work, I had weak signal, over lunch it was fine again, and currently (Still at work) I have no signal what so ever.


    I’ll get home tonight and it’ll be the same. It will keep going from full 3GS to a weak signal, to no signal at all.

    As you can see I obviously have the right settings and there is nothing in my area wrong as I can get full signal.

    This has not always been the case either, this is something that's been going on for half a year. I had no problems when I first took out the contract.

    I really do believe Vodfone are at fault here, as like I say I do get signal on some occasions and this is only a recent-ish problem, that I am growing angry and frustrated at, considering I’m paying £45plus P/M for a service that hardly works!

    Why should I pay an extra £50 on top of my already expensive phone bill?

    This is vodfone's problem, as like I say my signal goes on and off frequently and it was fine at the begining of my contract. This happens everywhere, home, work, pubs, when I'm out and about!

    To be honest this sounds more like a phone issue than a network issue. Do any of your co-workers who are on vodafone see the same issue?
