The Great 'Garden XL refused to sell me 500 BBQs at £3.19 each' thread

I'm getting this in now before the forum is bombarded tomorrow by teems of cretins signing up and lambasting Garden XL for their price error. this can be a one-stop shop for people to claim entitlement for a blatant and obvious misprice, rather than cluttering up the forums
Points to think about before posting:
a BBQ for £3.19? in what world would you ever expect this to be a genuine price?
yes, you may have received an order confirmation, but that doesn't mean diddly squat, only when the money is taken and the item is dispatched does that form a contract
no, you can't force them to sell anything to you, so move on.

Interestingly, their website doesnt seem to mention when a contract is formed.
However, it does contain the paragraph below:If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to proceed with the order. But does it state at which point a contract is formed?
In a bricks and mortar shop, offer + acceptance = contract, online.....its not as clear cut as that which is why retailers should specify when a contract is formed in their T&C's. Whether it be on payment, on them sending the goods, on confirmation email etc.
Ah someone on the thread shaun linked posted the confirmation email:Thank you for your order. This email is an acknowledgment of receipt of your order, and your offer to purchase these items is not legally accepted until we send you an email notifying you that the items have been dispatched.

Summed up well - there are people already having a go at the retailer on the Facebook page. Pretty low behaviour, and gives a very poor view of MSE and HUKD.

I saw that.
I also saw people posting on the facebook page earlier "thanking" them for their bargain in getting the oh so cheap BBQ and other stuff which had been priced at £0.
Nothing like giving the retailer the heads up, eh? :rotfl:

My favourite comment on the FB page
"If an item is mispriced in a shop then you get it at that price" followed by the same person saying " I work in retail so I know the legality of it"
