OP have you contacted the branch of the bank where this happened?if not then do so0

But the card was swallowed.
Either it will have been returned to the issuer, or it's a scam.
What did the screen say when it swallowed your card?
It just went back to the original "please insert your card" screen ... it was just like a computer had crashed and it rebooted if that makes sense? thanks for your response0 -

hello, we called them immediately, it has been 10 days since the original event
i called them again today and they are going to send me a dispute form, i asked them why they didn't offer to this in the first instant and they said they were giving the merchant 10 days to post it back into the account
i went into the post office today, i am very friendly with the staff who work there, they were upset over the situation for me, they said that a number of people who had the same problem as me on the same morning had their money posted back into their accounts almost immediately. they called the atm company whilst i was there and they said they were waiting for our bank to contact them! how bizarre this all is ....0 -
I read about a scam where the "cash ejection slot" is tampered with so it appears not to open, but you're actually looking at a blank panel and the cash disappears into some receptacle that fraudsters pick up later that day...
Is it possible that you've been a victim of some kind of ATM scam, which is why the CC company are messing you around instead of realising the error...?
i really do not know, this was the impression we got from the cc company hence why we contacted the police, when i told the cc issuer we had contacted the police they said, right we will get the fraud squad onto it straight away, so at least it got their !!!' in gear lol :money:0 -
This thread is stupid - why would credit card company get fraud squad involved when it is not determined yet whether there is any fraud involved?
Something not quite right here me thinks.0 -

hhi, it is not stupid to me, i am still a lot of cash down, i don't know why they involved the fraud squad ... rang them yet again ... now they said "we will send you a dispute form", i asked them why they didn;t do this in the first place and they it was because they had to give the merchant time to correct the error before they dispute on my behalf! anyway upon the dispute forms receipt it clearly states they will not dispute it until we have disputed it with "the merchant" first. it was a post office atm so how am i supposed to know where to contact!! they are just so not helpful and i am lost, i wish i could afford to just sack them off and close the account. <hyperventilation> help :money:0 -
Follow their procedure whilst you can, keep copies of what you send and notes as to conversations. Then go to the FOS if you get stuck. It will hardly help their cause if they've gone around in circles and not taken you seriously.
I like the way CCs talk about "disputing on your behalf". Your dispute IS with them. They are not doing you a favour or representing you! People get the same nonsense with S75 - as if they are helping you by pursuing a claim with the merchant.
The law is pretty simple. It is for them to prove that a transaction happened, not for you to establish that it didn't. (OK playing with semantics perhaps - but it's useful to be aware of the starting point in all this.) And of course in the case of S75 (albeit not relevant here), the CC is jointly liable with the merchant - they are not simply some sort of inbetween guy pursuing the merchant "for you".
Of course the vast majority of these cases will be down to cardholder error or fraud. But that's beside the point - if they wish to operate an ATM network then they have to be willing to deal with queries properly when they occur.
Good luck!0 -
please can someone answer this question as i am going around in circles ... is it up to me to contact the merchant as they have suggested, merchant being the post offices cash machine!0

You deal with the credit card issuer.
They deal with those who manage / own the ATM.
Forget the word "merchant" here. This is a cash transaction, not a purchase.0 -
