3 months further on and I am resisting contact and ignoring all letters. Thought it may be of interest to members that in the recent letter from Roxburghe is written:
"We are fully aware of anecdotal information being presented via the internet and on various websites and you may feel this advice is worth following. We strongly urge you to seek independent legal advice rather than rely on these opinions, and we would respectively suggest that you refer to the Civil Procedures Rules part 31* and more specifically parts 31.16 and 31.17"

They are lying. Those Civil Procedures Rules do not apply to the Small Claims track. They are fully aware of that, but when I made a complaint about this to the BPA they came back with the answer that that phrase was in the letter "for information" only (whatever that means.

If they are going to provide an "information service", why don't they give to useful information, such as the only time this bunch of clowns took someone to court, they made such a mess of the process, it never actually made it to court.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

They omit to mention that Part 31.1(2) of the Civil Procedure Rules says, “This Part applies to all claims except a claim on the small claims track”.

Parking charge cases are heard in the “Small Claims” part of the County Courts.

How can I put this kindly? I won't be asking them to draft my will. :)
The acquisition of wealth is no longer the driving force in my life. :)

Google it, any phrase. The letter is standard hamster bedding. :)

The absolute LAST thing they really want is for you to seek legal advice, Nick. Any competent solicitor will tell you to ignore it as it is all rubbish. It is just their idea of trying to be clever and raise doubts in your mind.

Ultimately, they invariably do nothing. You get passed to "graham White" (rhyming slang for something brown) who writes a couple letters (he's really Roxburghe using different headed paper) after which you get left in peace.
  • I wanted to say that I have not had any further letters or threats from Excel since June. I had all the ones I was told to expect, ignored them, and nothing since 12th June. I wanted to say thank you to you good folk on here who stopped me from paying up. I always wanted to come on here when it was over and offer my thanks and reassurance to others in my position- I hope I wont find something in the post tomorrow now!

Good to see you have come back and confirmed that nothing happened. It helps other newbies to see that our advice is correct.

    Well done you :D
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?
  • I also would like to add my huge thanks. Me and my partner received the letters from their "solicitor" and ignored them although my partner was not convinced and told me I would be the one going to court and paying the fine, haha. Since then heard nothing and this must have been back in June we heard the end as well. So thanks everyone on here your help has been amazing! Thanks!
