    As the cheque was cashed in full and final settlement of the situation, the ppc accepted that, so IMO it's the end of the matter. Besides they will never take it to court they hardly ever do. Think he should put his energies to the lease company concerned.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?
  • I dont mind the hard truth, I may have been foolish but I did what seemed right to me at the time and as advised by MSE- it suggested making a payment of what seemed a fair amount if the only argument against the charge was proportionalility- otherwise as I read the charge it was fair and not a scam. My family member messed up.
    I am going out for the day now, will park very carefully and think on the advice!

    I have to say, the advice on this board (not the forum) about private parking tickets has to be the worst I have ever seen.

    Well firstly you have already given them too much credit, why if after reading this forum did you give them £25 ? when the advice is always IGNORE.

    Oh well you did what you did and nothing can alter that, anyhow if you insist in contacting them again I wouldnt send the letter you wrote above, again you are giving these to55ers too much credit and are playing into their hands by saying you are getting stressed etc you are giving them more ammo as they now know that if they persist you could well fail and pay them the full whack.
    Short and simple as I have edited is all you need to do, if it were me though I wouldnt even bother sending that, just do as everyone says and ignore for goodness sake.

    I'm not having a go at you, but why when there are so many posters on here that have been through the scam and have not paid them anything should you feel the need to pay them £25, the most you or the driver owed at any one time is £1 ???? I cant understand the logic in paying what you did.

    It does need changing, and we have asked for it to be updated but it never is, it's causing conflicting messages to users of the website. Wonder if we can ask Martin Lewis directly to consider some changes ?

    I recall a scam some years ago where people sent invoices for goods and services (non-existent) to companies, knowing that if the amount requested was below a certain threshhold, they would be paid without being verified.

    The fact that companies paid them was not taken as meaning they had been somehow legitimised, as the perpetrators were done for fraud. For the stated Act to have effect it must be necessary for the invoice to have been lawful, and correctly rendered to the liable party in the first place.

    If I receive next door's electricity bill by mistake, and through distraction make an instalment payment on it, does that mean I have rendered myself liable to pay the whole bill? I do not think so!!

    I certainly agree with vax that the advice elsewhere on this board is not good and causes endless confusion. We should all be singing from the same hymn-sheet, and it seems odd that it isn't being updated in line with current policy, which is, by default, to ignore rather than write.

    Im sorry for jumping on this post but I am having problems with Excel Parking aswell and stupidly replied before coming across the complaints logged against them and this thread to ignore. I park on a piece of land that I pay £2 a day to park. For some reason on this day I recieved a parking ticket for not display a valid ticket however my ticket was on the dashboard correctly displayed. My only assumption is that the parking attendant must of missed it as it was at the bottom of my dashboard. I saw the parking attendant in which I expressed my upset towards him in which he told me that I would have to appeal. So i wrote the following letter:



    I am writing this appeal to you as I have recently been issued a parking ticket for not displaying a valid ticket on the 16thJanuary 2012. However on that day I did purchase a valid ticket as I do every day that I park my car on your site as I work in the Oldham Spindles Shopping Centre and as always I had the ticket displayed on my dashboard. That evening I returned to my car and to my amazement I had received this parking ticket. I had seen the parking attendant and queried this ticket with him in which his response was that I would have to write a letter to appeal. I still have the parking ticket in my possession and have sent you a copy of the ticket with this email. If you need me to send this off to you I would more than happy to as I am very upset that I have received this parking ticket.

    The letter then that I recieved told me my appeal was rejected as they had photograph which had been attached to the letter. Amazingly these are in black and white and it is very hard to locate the ticket on the dashboard, and these pictures have been cleverly taken a certain angles that misses where my ticket was. If i hadn't genuinely bought a ticket and displayed it then I would of paid this fine however it appears from this thread not to of even done that.

    So yesterday I recieved a letter saying that payment had not been made and if I do not in fourteen days they will be referring me to a debt collector.
    Now I am rather concerned about what I should do because obviously I know that I have paid and displayed a ticket however if I was taken to court I am worried by these pictures that I would not stand a chance. Although it is easy to understand the angle of these pictures, and are very hard to distinguish in black and white. What annoys me is I have paid for a ticket and I have displayed it and I do not owe Excel Parking any money whatsoever. They have not made a loss that day at all as I paid for the day parking and still have the ticket in my possesion.

    I would appreciate your thoughts and advice of what to do as like most innocent law abiding citizens I would not like the prospect of going to court.

    Michelle - you have done nothing wrong, you paid - you got a valid ticket....end of.

    You are no different than the rest of us regulars on here, we have all had threats of bailiffs and court etc and I dont think any of us have ever been taken to court over us not paying their ridiculous demands.

    Its Sunday afternoon now so go n fill the kettle up, make a cuppa tea, sit down, gather your thoughts and say to yourself "bollo*ks to them!", then get on with the rest of the day and dont think about them again, dont even think about contacting them again, you will still get the barrage of piffle from them so expect that, but dont stress they cant do eff all.

    I think you will realise now that these people are not genuine but are scammers who make their money conning people as they have tried with you. The parking attendant COULD have ripped the ticket up as soon as you proved you had paid. Instead he left you to put in an appeal to the SHAM appeals department, probably knowing, they turn EVERYONE down no matter what. Remember he has to generate income or he gets sacked...

    You paid the parking charge and you can prove it (save the ticket) it does not matter a hoot whether you displayed it or not so there is no need to continue the argument with people who are blind because they want to be blind. Seeing means they get no money off you........

    They will, in the final analysis, do nothing at all, because they CANNOT do anything. You will receive an assortment of toilet paper from them, from a firm of utterly useless, never taken anyone to courtDebt Collectors, and a fake solicitor who is actually the debt collectors using different headed paper.

    Ignore all that and they will realise they are wasting their time, they can't scam you, and will cut their losses and go away, never to return. To be fair they may bother you more than usual, because by "appealing" you have given the impression that you think the FAKE ticket is REAL, so the impersonators of authority will have been encouraged... but ultimately, after a few threats, they WILL go away.

    They invariably do.

    Or, if you want to get rid of them immediately by writing another letter, come back and I will draft one that will either get rid of them immediately, or open the door for you to claim money from them.

    Whatever, but please DO NOT worry, they are a pathetic scam that will NEVER take you anywhere near a court.
    Oh and btw Michelle edit out reference to place and date i your post, if you are going to have a try at suing them we don't want to alert them....

    And remember, all they "Excel" at is telling you lies.

    Yeah I can see from he gathering information how many people have problems with them.
    I just want it to be put to bed but I guess I will have some toilet paper letters due to come. Having of bought a ticket is the reason of appealing as I persumed that would be the end all. But realising what they are now I understand I shouldn't have bothered and have just led them on. I would appreciate if you could draft a letter so I could get them of my back I think thats what we all think we are doing by "appealing" anyway. I can't understand how they could take me to court when I have a valid ticket like you said. They haven't actually made a loss on my case. They have been paid for me using their car park, end of. I do not understand though how they are getting away with it.
