really struggling with moorcroft now!

Basically,

They rang me, and i said i wouldn't give my debit detailss over the phone but i'd be happy to set up a standing order - and they point blank refused give me there standing order details.

I feel a normal person until they ring me and i try arrange something - then i feel the most dumbest person in the world as they try feed me with all this information that i think they made up as they go along!

did i mension same phone call they said they'd agree to my offer if i payed £10 over the phone there and then paid by direct debit and agree to monthly only on direct debit,
yet when i said i'd send a recordered postal order to their address today of £10 then i'd be happy to set up standing order every month. but then they said they'd only do the 'deal' if i agreed direct debit, my partner over last few weeks thought i was making up stories to what they are like and thought i was just refusing to pay, however today i put them on loud speaker as he was there and he admitted if i didnt put them on loud speaker he wouldn't had believed what they was saying!

im going crazy, i wish debt was with anybody else!

    You need to stop speaking to them on the phone.
    If they ring then either don't answer or tell them to write and hang up, or if you find it easier don't confirm who you are and say that gemma is not available.
    And send the telephone harrasment letter to request all communication is in writing.

    A refusal to accept payment will see any county court chances thrown right out on their ear if defended on common law principle of you can not sue for what you have refused to take.

    i tried sending letters but neer hear anything from them and i'm trying to pay off the debt in installments, and i thought if i answer my phone and talk then it might stop them calling again, i only gave them my mobile and they started ringing on landline now - no idea how they got that number, i told them 6 times in last 2 days if they must ring please ring on mobile and not to use the landline number as for personal and private use only!

    this is why exactly i'm on last tether with them as communication to solve things is nil.

    You've pretty much said you always come off worse from the phone calls. here is no point talking to them on the phone. They'll say and threaten anything they like on the phone, and even if they agreed to a repayment plan or anything on the phone they'll go back on their word.

    Talking on the phone to them will more than likely increase the number of calls you get not decrease them.

    Don't have another discussion with them on the phone, if you do you will get nowhere and they will carry on as they are doing.

    Its not just moroncroft but all debt collectors who operate like this.

    What letters have you sent to them? have you sent the telephone harrasment letter? if so how long ago? What else have you sent to them? an offer of repayment or a prove it letter or what?

    just no idea i dont want no ccj's against me and that's what they said if i don't pay them what they want.
    i am offering half to what they want though, they want a payment straight away of £160 then £33 a month and im offering £10 payment in postal order and £15 a month after.

    there's also £14.60 interest charge going on my account every month.

    i not sent harrasment letter as of yet as only found out the other day on here i can.

    I've sent a recordered postal with a offer letter stating all my ins and outs (wasnt a professional one as only just noticed all the good words and templates on here.

    i got the postal order back and a refusel letter

    do it in writing. if they do catch you on the phone tell them you are recording the call as the oft have asked for evidence that they are refusing payment by standing order

    The fact you have made a reasonable offer will go in your favour should it ever go to court. If they dont like the terms, be firm enough to tell them you will no longer discuss a thing with them over the phone. If they dont like the idea of having to do it legally via writing, tell them you will be more than happy to let a judge handle it for you. They really dont want that to happen and they know it.

    Do not let them upset you, think they can bully you into their terms or blackmail you. Be firm, tell them straight and hang up the phone.

  • thankyou for your help - if goes to court how do i prove i have offered them payments i know they say they record all their calls but im guessing if its to help me suddenly they wont have that call on file !

    make the offers in writing. keep a copy. send by recorded delivery
