    Thankyou Errata, i contacted cccs yesterday who are sending me out a debt management pack, hopefully they will be able to negotiate something affordable, if not, im back to square one :(
    My concern is if they will make me include all debts in the dmp, i really do not want to as i have managed to stay on top of everything apart from the pdls , not really sure how that works....

  • Thankyou again Errata, i do not like to see myself as silly, rather desperate, i do not no whether anyone has been in the same position as me, but when you put your trsut in a partner of ten years and take out credit for your first home together its quite a shock to find yourself with debts that paying 50% was perfectly manageable, however paying 100% is not manageable and leaves you with not enough money to eat, feed your pet dogs, get to work etc etc its very, very frightening, and as my family are not well off, i really did not know where to turn, i was getting by month by month to try not to loose my home, yes i buried my head in the sand and refused to look beyond a month, but at that time i did not have the mental strengh to face up to where these pdl's were taking me. i did not get into this cycle because of greed or because i thought i would avoid the inevitable, i took the loans because i did not want to become homeless and i was frightened everytime i looked at my bank account. I am not by nature a silly person, quite the oppposite, but its strange what happens when you are under severe emotional strain and trying to make ends meet.
    I have been completely honest with CCCS and have found them helpful, however they are really trying to push for a debt relief order which i really do not want to enter into.

    i have entered all my debts, as they did ask for them, now im thinking i may not follow through if they enforce enclusion of all debts.....i really dont know, im trying to protect my future more than anything and really do not want to get in trouble with my bank

  • this is all so complicated.....
    i have a bank loan which is not in arrears, i have been paying back religiously for a number of years, i am worried that if cccs want to include all my debts, that i will be in trouble with my bank, i have experience of cccs, i phoned them early on during my problem and they were adament i include all my debts in any plan and told me i was paying my bank more than i can afford, i see their viewpoint, but sometimes it seems as though they look at the immediate problem and not the overall credit effect, i can understand this, but i really do not want to mess my bank around by including them in a debt plan, i realise this may not be an option i have so i am looking into some other options....

    If you enter a DMP with CCCS (or any DMP provider) you will need to include all your debts and they must all be treated fairly. But see this is a good thing not a negative - all your debts will be on manageable repayments and you'll be able to live again properly.

    If you were thinking about keeping your other credit lines open so you can still use them then you cannot use any new credit under a DMP
    And if you were thinking it would be better for your credit file to only default on pdls then its not, if you are entering into a repayment plan with payday loan companies then they will issue defaults, and so going into repayment plans with the other won't make any difference (ie there is basically no difference between 6 defaults on file and 3 defaults on file).

    Your creditors (including pdls) are most likely to accept your repayments if you treat all fairly and are seen to do so.

    I shouldn't worry about upsetting your bank regarding the loan - you need to move to a new bank anyway, and you have an unauthorised overdraft with them,

    Cancelling your bank card does nothing. They have teh SC and AC number so they will just dive in and take it anyway.

    sorry but they do. The best advice that is given on here is to change your bank now and then set up a payment plan with them.

    what utter nonsense, nothing can be done with a sort code and account number, bar set up a direct debit, which if the customer hasn't authorised would be fraud.

    I know from experience that with HSBC, santander and RBS that when you cancel a card no further payments will come from that card.

    Or are you suggesting that the bank will leave themselves and their customers open to fraud from the continued use of a cancelled card?

    ah right i understand, not sure how it works but im sure theres someone on the forums who would know more, tixy might be a good shout.

    Im pretty sure there are posts on here from people who say they cancelled the card yet payments were still taken
  • hi Tixy, no, i wasn't trying to keep open the possibility of further credit, thats the last thing i need, i just wanted to keep my repayment issues to the people i really can't afford and try not to mess up my bank, but i see your point that it really doesn't make much difference,very scared of making the wrong decisions.......
    I have the prospects of an increased wage within the next year, but this obviously means nothing to the pdl's, i am nealry qualified and will see a significant pay rise when this occurs, my worry is that i ruin my credit report for years, i really do not want to, i have had some advise to pay off the debts with a 15 month 0% credit card (so i get lower monthly repayments until such time that i can increase them before the 0% period is up to avoid further debt) im sure most would advise against it, but this could potenitally protect my credit rating if i ensure i keep up with payments.....??
