Lloyds TSB

Hi,

Last Friday £180 from a benifit payment has been taken from my mothers lloyds account,
It wasn't her benifit therefore they said they couldn't do anything immediately so we was told to wait till they debited and they did on Tuesday so she went in and filled the forms out ect...

They said it would take anywhere from 14-30 days before the money is put back....


I have now heard from a friend tonight that under new fsa rules the money must be refunded in 24 hours?

Is this correct ?

  • Just to update, we have contacted Lloyds who say they are under no reason obliged to adhere to FSA rules as these are purely guidelines and most banks do not take notice of them in regards to this particular matter :S

    What do I do, we really need the money at the moment???

    Can you clarify the situation please.

    Are you saying a state benefit was paid into your mothers account this benifit was for someone else. Lloyds took £180 in charges that your mother owed to them.?

    If that is the case then they are entitled to do so and have no legal obligation to return the funds.
  • It was debit card transactions, I must have forgotten to mention that on the posts but thought you would have worked so much out from the mention of debited.

    I don't know where you got charges from, her accounts in good standing.

    This makes no sense.

    A £180 fraudulent debit card transaction has appeared on your mother's account?

    What does the benefit part of it have to do with anything?

    Slow down. Take a deep breath. Then repost in the following format (showing the order of events).

    1) £180 went in to my account that shouldn't have done.
    2) I spent some money on my debit card.
    3) Somebody else stole money using my debit card.
    4) LTSB paid the transactions.
    5) I think they should refund them because.

    Lots of people would like to help you. But at the moment don't really understand what's happened. My list is an example. I haven't got a clue what's happened. You're the only person who knows. Share it with us clearly.
    I must have forgotten to mention that on the posts but thought you would have worked so much out from the mention of debited.
    An ATM withdrawal gets debited to an account. A counter withdrawal gets debited to an account. A direct debit or standing order gets debited to an account. An international payment gets debited to an account.

    I thought your post came across as a bit rude, given that you're the one asking for help.
  • 1) 12 AM - 3 AM Friday - My Benifet Payment of £180 Goes Into My Mothers Account.

    2) 11AM Friday - Money shows on account but isn't available.

    3) 12PM Friday - Talking to the bank reveals that 18 transactions of £10 were made on the card (Internet or Phone) one after the other around 10AM Friday.

    4) 12:30PM - Informed by the Bank that payments wouldn't show as debited untill Tuesday or so, and thats the only time they can resolve the matter.

    5) 3PM Tuesday - Went into bank, filled out forms ect.. for disputed payments, we are told 14-30 Days to resolve the matter and have the money repaid into the account.

    6) 10PM Wednesday - A friend informs me that they should be giving it back immediatly due to new FSA Regulations.

    7) 9AM Thursday - Call bank only to be told that they are not required to follow FSA Guidlines in situations regarding debit card fraud.


    And to clear it up, the previous post was in no way intended to be rude, maybe its worded as such but I can clearly say it was not. I was just baffled at where bank charges came from as there was no mention of them.

    Thanks for clarifying. Bank charges were brought up as that's one reason why money can be taken unexpectedly from an account, and until now we had no way of know what had happened.

    Point 3 - are the bank saying that 18 transactions were made with your mother's debit card details, either online or by phone? Just want to make sure of this.

    Presumably then they were purchases of some sort, what was the organisation that they were made from? It might be possible to do chargebacks to recover the money.

    Has your mother's card been cancelled and a new one issued? If not then the same thing could happen again, so that is a priority.

    I'm not sure on the rules, but it sounds right to me that the bank don't have to immediately repay, and that they can do their investigation first, although I'm happy to be corrected on this.

    A subsidary question is why your benefit is being paid into your mother's account rather than into one of your own? If she is either receiving benefits herself no or may want to in the future this could be seen as income and hamper her ability to claim.

    I made an assumption that bank charges may have been involved from the information given in your first post. You mentioned £180 being taken from a benefits payment.
    Such questions are usually along the lines of "the bank took charges from my benifit payment my friend told me it was illegal but they won't give it back"
    It wasn't clear from your OP that the payments were fraudulent.

    I made an incorrect assumption. My intention was to get you to clarify what happened which you have now done.
  • As I see it a total of £180 was earmarked to come out of mum's account (which is why the benefit money was not showing up as available).
    If this is correct then the bank would be correct to say that they could not do anything until such time as the funds were actually debited or the earmarking dropped off.
    I don't think Lloyds get you to fill in forms in branch as you get to speak to fraud on the telephone - they send out forms to confirm that the transactions were not hers.
    Once this has been done the monies will be refunded.

    there could be a few reasons why James' Benefit is being paid into his mum's account that would be legitimate. However the reasons could be personal to James that he feels he doesn't want to say. That is his right to do so, even though members here are genuine in their responses to help.

    Very frustrating though I am sure when banks legally spin the time out. James and his mum might only have just enough in the account to pay for bills and expenses, so a stituation like this would make life very difficult.

    James, do update us on how long the bank actually do take to refund the money.
