I am somewhat surprised at this debt collection agency involving themselves in this as your friend has no legally binding signed agreement. I am also surprised at their making threats to go to the police and solicitors and claiming to have appointments with these people. I believe that you should make a complaint against the written threats on the part of these debt collectors to contact the police to the appropriate regulatory authorities.
You don't say how much money is involved and how much the debt collection agency are charging your friend for their services, but consider the probable cost of this soliciors appointment against how much money this agency are expecting to make if they collect the debt. Also consider if your friend wants to loose that much of the money due to her; the debt collection agency won't be working for your friend for free!
I'm sure that the police would refuse to even discuss the matter with the debt collectors. If your friend is claiming some some sort of fraud then her (or her solicitor) should contact the police to make the allegation themselves; the debt collectors would not be involved in such a matter. In the event that you should be charged with a criminal offence (fraud or similar), which I think is unlikely, then you will presumably be entitled to legal aid. However, going to the police and trying to have you charged with a criminal offence would be counterproductive for her as it will NOT result in her getting the money.
From what you have said, I think your friend has lost the moral right here and you should no longer cooperate with her. Don't pay her a thing and ignore all correspondence from debt collectors, solicitors etc unless you receive genuine court documents to the effect that she is taking (civil) legal action against you to recover the debt. However, my personal opinion is that in the absence of any signed agreements between you, she will find it quite difficult and potentially very expensive (she can't be sure she will win) to sue you. You will not be contacted by the police regarding a civil debt.
If anything genuinely untoward happens (threats, people turning up at your door etc) then YOU go to the police and report your friend for harrasment, blackmail, attempting to obtain money by menace etc.
And above all don't worry ...
Your entire post is ruined by this. And it is somewhat !!!!!! advice. Why shouldn't she pay if she owes it?
The appalling behaviour of the friend does not invalidate the debt.0 -
I have siad throughout that i have never refused to pay the debt and even offered this company all I had at £140 a month, but they refused.0

Yes it is a real agency,I did ring to check, and they have put this threat in an email. It is a company called debt solve uk
I'm sure they are a real company. Still don't have any "powers" or "rights" that allow them to impose their will on you or harass you.I did some things for her that I found hard to do,ie rang her sons girlfriend and lied about a phone, and she said when she lent me some money she was because i had helped her wit that, but this was said on the phone.
I mentioned this to her recently and she said i was blavckmaiing her, maybe she is accusing me of that now too
I appreciate its easy for me to say and more difficult to do when you're in the middle of it all, but try not to worry too much about what she might or might not be saying. Talk's cheap. What matters is what the facts are and what can be proven. If you don't stand for something, you'll fall for anything0 -
my worry is that the DCA seem to be having a meeting with the police and solicitors, not the people i owe, unless by the WE they mean all of them.
They seem like a reputable firm,I cant see why they would lie,but it seems they are now accusing me of blackmail too.0 -

Let them. I don't see that they have a leg to stand on. My advice is to refuse to worry about any of it until they show some proof.0 -
The DCA CLAIM to be meeting with the police and solicitors. So that would be for a fatboy breakfast at McD's then as they're all just mates really.
Unless I've misunderstood your posts earlier, your 'friend' isnt going to come out covered in glory with the police if she suggests you're blackmailing her because she got you to ring her DIL and lie to her, so I really don't see why she'd expose herself ... In the unlikely event that the police wanted to speak to you, you'd be entitled to have a solicitor present (and you must if you are making a statement or asked to sign anything), so if it was a 'favour to a mate' for her husband at the nick, they'd be running a real risk of kissing goodbye to their pension.
It's smoke and mirrors. These are threats and intimidation to bully you in to paying a ridiculously inflated sum, because you are vulnerable. As others have suggested, where is the loan agreement? Regardless of the fact that you fully intend to pay, without that who's to say there's even a debt to pay?
You say she uses her husband's role in the police to threaten people. His professional standards department would love to hear about that, regardless of whether he is staff or an officer because of integrity/reputation issues.
You've never said you dont want to pay, just that you cant give it all to her right now. You have offered installments. Even if this so-called DCA choose to pursue you to court for the money, you can show you have offered to pay in installments (and have been paying, if I read right?). They are not bailiffs, they have about as much oomfh as a eunuch (sp?) at an orgy, so hold your ground.
Please dont be intimidated by them. They have no power, but they won't tell you that.
And make them put absolutely everything in writing, so you can take it to get advice and reassurance from CAB or another such organisation.LBM July 2006. Debt free 01 Sept 12 .. :T

Hi
I am afraid,im jst not sure what the police involvement will be for,I have no fraudulant intent and I was open with the dca as to what she had said to me.
I am agrophobic and the thought of being dragged to a police station with all those people makesx me want to run and hide.
I was in regular daily contact with my friend, giving her updates everytime I heard when the money may arrive, until she started to tell me spirits were giving her messages and i got afraid and backed off, maybe the wrong thing for me to do.0 -

???? Oh dear, she sounds to be several sandwiches short of a picnic. Don't worry, just stop all contact with her, don't text, email, write, phone, just carry on paying as you have done before. If she puts you in court you will have a brilliant record (providing you have traceable records, ie cheque records, receipts) or paying her back and no court will order you to do any different.
She's just trying it on.0 -
as you have been told call the complaints deptment and get someone to come and see you. they will not be nasty to you as you have not committed a crime. however the abuse of power of the husband will see him serving time. think of the asian cop from the met. i hope you have printed all the messages off that they have sent you.
back to the loan for it to be inforcable it would have to have been to a county court. however by placing this intimidation on you its quite possible that a judge would kick the case out.
now you said that a lot of the debt was for stock. how does this become your debt even if you messed up its her buisness and she is responsable for her stock ordering and security. funny really a woman gets conned by someone when her husband is in the plod.
just because you feel guilty over her losing money does not make it your debt.
could you itemise what they claim you owe them.
have you checked on the phone with the debt collectors main number on the web to make sure that they are who they say they are. after all they have used this action before. email the director of the firm/ complaints and make sure this is true.
the last bit either indicates she is a nut or this thread is fake.0
