Personal loan,please can someone advise me.

I am in a terrible state and not sure were to turn for help.
Someone I thought of as a friend gave me some money when she got a lot of money from her husbands pension,I had done a lot for her,work wise,and she offered me some money.
I was in a bad place and I excepted,she then loaned me some money after I wrote to ask her if I could borrow some until I was paid what my brother owed me.

She then gave me gifts,and had me do work for her sourcing stock,and told me not to make instalments to pay the loan of £6000 back when I got the fnds.

My brother refused when the time came to pay me so my partner and I found another solution and we are now waiting for funds to come in from his pension.

However,my friend has now gone to a debt collection agency who are writing to me giving me 7 days to pay.

The letter says that I never offered instalments which i have,and the debt they say is now almost 13,000,all the gifts etc added on.

They are threatening me with the high court,and they have added my partner to the claim.

I do want to pay this back but after asking for a breakdown 4 weeks ago I have had nothing,just money added on.

I did things for this lady that I have never done for anyone else,and thought of her as a sister,I have replied to the company again offering all I can afford in stalements.

Can anyone advise me

    Okay the money she loaned to you (not the gifts etc) - is there any sort of loan agreement drawn up? do you have anything signed that states she gave you a loan? or any written communication from you to her admitting its a loan - ie a letter saying thank you for the loan or I would like to start repaying the loan etc etc?
    Equally do you have anything in writing from her that some of the money was gifted at all?
    What was in the letter you sent to the debt collectors offering installments?

    You say you asked for a breakdown 4weeks ago - was this in writing and if so what did it say?

    Who is the debt collector that has written to you?

    Have you spoken directly to your friend about this? There appears to be a missing chunk of the story between her giving you a loan and a DCA asking for missed payments.

    The £6000 I asked her in a letter to loan it to me,I thanked her by email I think,but it may have been by phone.
    She talked and made the offer of gifts on the phone,so I have no proof but no I have never been given any agreement or signed anything but the letter asking for the loan.
    Also they have added my poor partner onto this knowing he is in renal failure and is terified of debt.
    He owes them nothing,I owe them.
    The company writing to me is Debtsolve.
    I made the offer recently of £120 a month until I could get a lump sum,and I have told debtsolve that too.

    Yes there is a long story but I didnt want to baffle all.
    We have been waiting for the payout from my partners pension so that he could oan me the money to pay her,it takes a long time to go through and she is not prepared to wait any longer.
    I am not saying I dont want to pay her,and I have been talking to her on a daily bass until ast week,she was my best friend.
    I think it boils down to the fact her husband didnt know what she was giving as gifts and he has found out.
    She knows I wanted to pay her back,I have never for one second said I wouldnt

    The DCA arent asking for missed payments,no payments were ever agreed,she told me to wait until I had the money
  • Ok. A quick google of Debtsolve seems they are a company that will try to collect on debts for businesses and individuals.

    But the key thing in your case is there is no agreement. Officially, there is no loan - it doesn't exist. Which is good news.

    So first thing is to stop worrying. Then, appreciating that you want to pay the money back in any case, you should talk to your friend about over what period you can pay it back. But there's no realy legal standing for her or Debtsolve to demand payments or take any action that you need to be concerned over.

    There are others on this board who are much better informed about this kind of thing than me, but you're not about to be dragged off to prison. It seems she's just jumped a few steps from wanting her money back to using a DCA as she seems unable to talk to you about it.

    She's probably gone to the DCA thinking that you would pay up once you get the letter because as the OP says the husband has probaby found out what his wife has done and went ballistic at her.

    i borrowed some money over a long period from a friend,she has now demanded the money back and gone to a debt collection agency.
    They are trying to force me to make large payments i dont have,and they have said they have a meeting with police and solicitors tomorrow.
    Im very afraid,can anyone advise please

    Its a civil matter so i cant see the police being or wanting to get involved.

    Is there any proof that details the loan was made ?
