    There seems to be a lot of people kicking around these boards at the moment who are either owed or owing money to an ex boyfriend or girlfriend. Surely we can match up at least one pair?

    I presume that the degree was not in English or financial management. Perhaps you might like to look up the difference between the meanings and usage of "there" and "their". Also "solicitor" is not spelled "solister."
    I can afford anything that I want.

    Hi :)
    I split up with my partner last year. During the time I loaned him money out my student loan. The first amount I made him sign a loan agreement, he then got into money trouble and I loaned him more without a new agreement. On top of the original agreement I had a chart that he signed every time he gave me money. Included in the money he owes me was the deposit for a new car (in his name) I out on my CC and also the insurance.
    Up until i left the home (I lived their 3 years but as mortgage was in his name I had 3 hours to leave) he would pay me back.
    I manage to get the loan agreement and chart he would sign (a bit screwed up as he tried to take it)
    Since I left he is refusing to give me any money by saying I lived their rent free for all these years. (I paid my way for a year and a half but before then I was a full time student) I recently got copies of my council tax and it states I was only ever on the council tax for a year.
    I am owed £3800 which aint a huge sum to most, not sure of next steps, if I go small claims is it worth have a solister (and if I do can I claim back legal costs) or if I have enough evidence for a claim.
    I have no bank statements showing a transfer of the money as it was cash
    really appreciated advice

    So you have some form of evidence?
    Money Claim online is how you would go through the small claims court, you do not need a solicitor, you just need your wits about you.

    Is there anyway you can get some form of confirmation by text or email....ie you text him saying 'Oi you owe me £****' and he goes 'Yeah but I'm not paying you'

    You get that printed by phone provider and that is your evidence along with the 'loan aggreement' that he signed.

    The fact that money was paid in cash actually isn't in his favour....technically he can't prove he has paid you.

    Basically, if in court (which is just a normal room) the judge thinks it is more likely you are telling the truth, it will go in your favour. He will get a CCJ and be required to pay. He may decide not to but his credit rating would be screwed. It might scare him into paying you.

    Emails/facebook messages/texts can be used as evidence

  • if you have a legal agreement this is genuine debt for the original amount, im unsure about the additional expenditure. as there was no rental agreement if u lived with your ex rent free or not he can not argue the cost as its co-habitation.
    if your a student - can u get legal aid?

    question is though if you do get a county court judgment against him, will he pay it? is it worth chasing as if he cant pay - it will just cost you time/money
  • £3,800 is a huge amount of money to most people. I was shocked to read that you thought it wasn't.

  • In response I am dyslexic and my spelling is terrible, luckily my degree was in engineering.

    I am no longer a student so no legal aid. Unfortunately he is to clever to admit it via text, emails etc but I have a bit of paper signed by both of saying it was a loan and another chart I made in which every time he paid some money off I would write it down and we would both sign.
    I didn’t know if it was worth going via a solicitor or doing small claims myself. Also if I chose to have a solicitor would I be entitled to claim back the legal costs

    He works in banking so he cant have CCJs against him

    But he can still have CCJ against him though but if he has no job he will find it hard to pay you back.
