Money Owed by Ex

Hi :)
I split up with my partner last year. During the time I loaned him money out my student loan. The first amount I made him sign a loan agreement, he then got into money trouble and I loaned him more without a new agreement. On top of the original agreement I had a chart that he signed every time he gave me money. Included in the money he owes me was the deposit for a new car (in his name) I out on my CC and also the insurance.
Up until i left the home (I lived their 3 years but as mortgage was in his name I had 3 hours to leave) he would pay me back.
I manage to get the loan agreement and chart he would sign (a bit screwed up as he tried to take it)
Since I left he is refusing to give me any money by saying I lived their rent free for all these years. (I paid my way for a year and a half but before then I was a full time student) I recently got copies of my council tax and it states I was only ever on the council tax for a year.
I am owed £3800 which aint a huge sum to most, not sure of next steps, if I go small claims is it worth have a solister (and if I do can I claim back legal costs) or if I have enough evidence for a claim.
I have no bank statements showing a transfer of the money as it was cash
really appreciated advice

  • You are tight, you lived there for free and you expect him to pay you back. Pay him rent then argue to him that he should pay you back.

    You might have a reasonable chance of getting the original loan paid back, but unlikely for the amounts for which you have no written agreement.

    If you couldn't afford to pay any contribution towards rent whilst a student how could you afford to give him money (even if you counted it as a loan)?
    loose does not rhyme with choose but lose does and is the word you meant to write.

  • When we moved in together I was at uni and also rented a room at uni but stayed with him when I was home.
    During this time I did have a part time job where I would contribute what I could weekly and also out my student loan I would pay for up keep even though I never had a written agreement.

    When I finished degree and got a full time job, i would give him money each month. I dont see how he can use the I lived their rent free excuse when he new my situation when I moved in, I paid what I could and he didnt legally declare I was living their to council until quite recently so he could claim single persons (I was coughing up my share of council tax to him)

    The money owed was a lump sum as he run up loads of debts on credit cards that were coming to their interest free period, I had also sold a car at that time.

    The original 'Loan Agreement; which was signed said £3800.
    I then loaned more money and on the repayment chart (which stated how much he had given me, how much of the loan was left and was signed by both of us) I added on the extra. He had been paying me back then we were both signing it up until I left.
