hypothetical question if selling a car

These things are fairly common. Think of how many company vehicles and lease cars there are where more than one person has permission to drive.

When I say they I mean He/She the buyer not two friends taking the car for a drive without seller in the car . The situation would be the buyer ( 1 person ) test drive the car and the seller would be sat next to him/her in the passenger seat when the driver (buyer) is caught speeding by rear gatso camera and denies driving saying he/she was the passenger.0 -
Keep hold of his licence while in test. If he gets flashed note down all his details and license number and tell him to expect a ticket in the post. If you have all these details of who was driving I doubt it would carry much weight if he said he was a passenger.0

I believe currently the onus is on the owner to tell the police who was driving but on the Police/CPS to prove who was driving if it goes to Court.Is the onus up to the police or you to prove who was driving at the time. Would the other driver get away with it?
Difficult to say if the test driver would get away with it, depends on circumstances, for instance if the Police didn't believe the owner and prosecuted him instead the test driver wouldn't be involved (except as a witness).0 -
If the police came back to you, giving a statement telling the truth about what happened would be enough.0

Like most things ifs and buts and what ifs, you should always go with them for a test drive.0

I would never buy a vehicle from ebay unless I could see and test drive it prior to making a bid. I am sure ebay advise this and everytime I have watched Wheeler Dealers this is what Mike Brewer does before bidding.
I merely suggested a way out of offering a test drive.
Either allow a test drive and risk points or don't and don't risk points.

Ask your questions, look at the sellers feedback and work out if they're trustworthy or not then place your bid.
When you go to pick it up, make sure it's as described then pays your money. If it's not as described, walk away.
If it says 'drives brilliantly' in the ad, you pay the money (without taking it for a test drive first), go to start it up and nothing happens...what would you do then?What is pi? Where did it come from?0
