hypothetical question if selling a car
I have never sold a car to a stranger (privately) I have sold ones to mates and traders but I was wondering out of curiosity if the following situation was to arise what would happen.
A buyer comes to test drive the car you are selling.
You check his/her licence and insurance to make sure they are legal to drive your car and all is ok.
They drive your car and while out driving they are flashed by a gatso (rear facing camera) for speeding and after the test drive they just rush off refusing to discuss the matter.
You receive a NIP in the post. You send the NIP with the name of the other driver to the police. He denies driving and said he was just a passenger. Is the onus up to the police or you to prove who was driving at the time. Would the other driver get away with it?

you could dispute it and ask for the copy of the photograph that was taken at the time unless the prospective buyer looked like you. I have seen a picture and they are so clear you can actually see the person driving the car. So you could well dispute it that way if you supply the persons name and address as the driver they can match the details to the picture.

I am talking about a rear facing camera GATSO which takes photo number plate only.
you are talking about the TRUVELO which is front facing and can take a picture of driver's face. It's a different scenerio.0 -

Spot on mate.
I would never buy a vehicle from ebay unless I could see and test drive it prior to making a bid. I am sure ebay advise this and everytime I have watched Wheeler Dealers this is what Mike Brewer does before bidding.0 -
Bought 3 motorbikes and 3 cars from ebay without seeing/test driving first and never had a problem.
Ask your questions, look at the sellers feedback and work out if they're trustworthy or not then place your bid.
When you go to pick it up, make sure it's as described then pays your money. If it's not as described, walk away.0 -
As described means with working brakes, engine, gearbox, steering. So I'll pay after a test drive. No test drive, they can re-list it. I've never had any problems yet.0

Hypothetically - You only gave HIM the right to drive your car, not his friend. If he's then given his friend the keys to drive your car, both he and his friend are guilty of TWOC and / or allowing onesself to be carried in a TWOC'd vehicle. A quick call pointing this out might well create a surprising memory correction and an admission that he was in fact the driver after all.Is the onus up to the police or you to prove who was driving at the time. When you name him as the driver, the police would send him almost the same letter as they sent you, asking him to name the driver. Failing to do so will get him 6 points and a fine.
These things are fairly common. Think of how many company vehicles and lease cars there are where more than one person has permission to drive.We need the earth for food, water, and shelter.
