Paypal claim - but returned item being sent back to me?

    Yes, that is exactly what you should do.
    Enter the tracking number and add a message saying that the seller has refused to pick up the phone and it is now being returned to you as can quite clearly be seen by the tracking information.
    Paypal should pay out no problem.

    Ring paypal and speak to someone. Clearly explain whats happened and they should decide while your speaking to them. Don't leave it to chance! As others have said you might need to remind them of their own rules

    Just a quick update - it's all been resolved. I called paypal, and they asked me to scan a copy of my proof of postage for returning the phone. Which I did, and they then refunded me today.

    Very happy it's sorted, just don't know what to do with the phone now. May post it back to seller without paying postage so they have to pay the other end.

    I would contact the seller & tell them that you'll return it again when she sends the postage costs.
    Did you have to sign for it when it was returned to you?

    No, I didn't have to sign for it when it was returned to me.

    I will message them if needs be, but I must admit I'd rather not, as I have a feeling they won't be very civil considering how they've strung this out and have now had the money unexpectedly taken out of their account. Hmm.

    The postage costs to return the phone again, and also the postage costs incurred sending it back the first time.

    The phone legally belongs to the seller but you don't have to be out of pocket in any way for having to return it to them.
    They had the option to collect it from the post office the first time and as they chose not to, they should bear the cost of this, and if they still want their phone back, again they should pay for it.

    At the moment I'm leaning towards just putting into the post box without paying for postage, so they have to pay at their end, abeit with a £1 handling fee. I doubt they would appreciate it, but I don't like having it now that I have my refund.
  • The only problem with doing that is that if the phone was to go missing, the seller could claim that you failed to take good care of it and that you breeched your duty of care.

    It's very unlikely that they would attempt any legal action, but the possibility is there.
    I would at least give the seller the option of paying all of your costs incurred in getting their phone back to them, and if they fail to do so within a reasonable time, then do as you sugested and post it back without payment.
