Anyone dealt with District Enforcement?

I received a 'Parking Charge Notification' from them on 14th December, couple of obvious problems stuck out to me with it. My car is silver, they put its light blue; The only signs on site are up high on lamp posts around the car park say one hour park, no return within one hour. The notice says first observed 11.15, ticket issued 14.08, overstay 173 minutes.
No cameras are on the car park, so the overstay is ????
I've now got the Parking Charge Enforcement Notice through the post, threats of 'a judgement' will be sought against me. They also claim if i refuse to tell them who was driving they can get a court order to force me, or be in contempt - is that true?

    A scam that impersonates authority, they have no authority to fine, or charge you anything, do some digging you will soon get the plan.
    They deliberately make mistakes to tempt you in to a fight so they can stick claws in to you.
    Ignore them, get ready for lots of threat letters and changes in characters along the impersonation route.
    Open any kind of dialogue with them and you will become a victim.

    Read the stickies and then ignore their bog paper. There isn't going to be any "judgement" or any court order to force you to tell them anything. I expect the regulars will be along soon to reinforce what I have said.
    I can afford anything that I want.
    Just so long as I don't want much.

    3. Watch the Watchdog clip on the same sticky thread.

    4. Ignore the scammers and tell your friends/family about this con.

    5. If there is a landlord or retailer onsite, write and COMPLAIN about this harassment, threaten to sue them for the actions of their agent (but do not 'appeal').

    District Enforcement hit the streets a couple of years ago founded by three recent graduates of Staffordshire University law school. They boldly stated at their formation that they had "the" answer to enforcing private parking tickets but there has been little evidence of that and so well have they done that one of the three has jumped ship and gone back to graphic design.

    It is thought that the so-called answer they had was to use what is known as a Norwich Pharmacal Order. Such orders can be obtained from a county court to oblige third parties (such as car owners, it is claimed) to disclose the names and addresses of the people the applicant wants to be pursue. Unfortunately these order were designed to be used to obtain documentary evidence and how many of use keep a written record of when our sons, daughters, brothers, sisters, spouses and partners use our car? Exactly.

    One private parking company tried twice last year to obtain a NPO against the same private individual to get them to disclose who was driving the car at the time of an alleged breach of contract. The judge threw out the applications on both occasions. To our knowledge here DE have never actually sought a NPO.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

  • Even if they were to get over the inability to find out who was driving, they still have no answer to the problem that the companies cannot impose any form of penalty and therefore can only claim for actual losses; which are at most a very small amount, but very often are zero. That's why they get spanked on the very rare occasions that one has been stupid enough to try it. So they rely entirely on bluff and upon the average citizens lack of knowledge of the law.

    Ive had a run in with these guys and got paperwork through my door this morning from moneyclaim online or northampton county court with them claiming a stupid sum off of me. Its giving me a choice to contest it, pay part or pay in full within 14 days, the paperwork is legit after checking the moneyclaim online website. Do you guys have any advice? I don't think it was me driving the car that day and I havent had any contact with district enforcement yet.

    You do need to enter a defence (otherwise they can "win" by default).

    Put this on pepipoo ASAP and you will get best advice!

    Advice would be to check that it's a real claim first.

    Is the paperwork correct, with a claim number, a 'cause of action' and a Court seal? If you ring the Court on Monday they can tell you whether the claim number is a real claim.

    You are going to be very sceptically regarded until your bona fides are proved. There are reasonably frequent posts here from individuals who have never visited before and claim to have received court papers from private parking companies or to have recently lost cases to them. There is good reason to believe that the majority of such posts originate from PPC's themselves - hence the scepticism.

    I suggest that you make your way across to pepipoo.com and set out your case there. You will need to be able to post a scanned in copy of the claim form you have received - depersonalised of your name and address, case reference number (that will include any case reference number that DE may have placed on the papers), barcodes and online log-in details together with any other detail (dates, times and location details) that might identify you. You will probably be asked to disclose your case number to a trusted member so that the online details can be checked.
