MBNA PPI Claim Refused :(

Well I'm totally gutted, received a reply from MBNA today saying they're satisfied that I was not missold PPI and they regret that i'll probably be disappointed by this.

Anyway the claim has been exhausted according to them and I can only go to the FOS to take it further.

I'm saddened by this. :(

  • What I should be asking, is would you take it any further?

Hi Lemontella, If you feel strongly that it was mis sold and have valid reason/reasons, FOS it, you will have to wait up to 12 months but don't give up if you think their decision is wrong ;)
    Successes
    Sainsbury's/BOS £6,400 Paid :)
    MBNA £3,600 Paid :)

I am not sure if I have a valid reason, although I do feel like it was mis sold if that makes any sense!

The application was via post, there was a PPI tick box for Yes only, underneath this tick box was a bold sentence 'WE STRONGLY RECOMMEND YOU TAKE THIS INSURANCE' I felt pressured into ticking the box without anyone telling me to do so!

Maybe I shouldn't have been so stupid to tick the box, my guess is that their application forms are designed this way so the applicant feels pressured.

    Gutted :(

Don't give in, send it to FOS and state the above. The statement "WE STRONGLY RECOMMEND YOU TAKE THIS INSURANCE" without any further explanation is pressurisation. It didn't give you the option of shopping around for cheaper cover or even suggesting you could. Remember PPI was added to loans and credit cards because it was HUGELY profitable for the banks. For every £100 they took in premiums they only paid out £11, compare this with car insurance, every £100 in premiums they pay out £78 Now you can see why it was peddled so heavily :(

  • Thanks for the pep talk you guys, I thought I had such a ridiculous reason but the more I think about it, I suppose it is worth a try.

I'm going to send everything off to the FOS tomorrow.

Your comments are truly appreciated. Thank you :)

I also received a letter from MBNA yesterday stating the same info as you, I've not challenged this yet! I am rather annoyed as I'm pretty sure when you apply on line you have to accept the pre ticked box!!! although its in 2007 I can't remember. Anyway, did you write to them again or call them? or was it straight to the FOS or worth calling them? Your help would be much appreciate! Thanks

If yours was not a final response, then get back in touch with them, tell them that you have just found out this could have been a pre ticked box,and you do not remember it saying you did not have to take this insurance, reiterate the reasons you were mis sold this ppi, sickness pay, life insurance etc ask them to reconsider the rejection or you will take this to FOS to get this looked at again
