    Has she got a case???
I wouldn't have thought so. The bank has a right to bounce any incoming direct debits once you exceed your agreed overdraft. If you wish to discuss this further, please create your own thread.

itsnotfunny: You have a choice. You could for example take out a loan to pay off the bank charges, putting your account in credit. You would have to pay off the loan with monthly installments. This would also prevent further bank charges.

    Why are the charges unfair?

the charge does not reflex the true financail loss to the bank and are therefore unfair , but the test case voted against such fairness on personal bank accounts soley because the banks would have to pay out large sums of money on top of ppi claims and prob go into administration if they were found guilty ,

under no circumstances should you take out a loan to soley pay a bank for its greed in relation to its charges which contribute to a 1/3 OF ITS PROFITS , change your bank and agree a payment with them to pay the outstanding amount off , they dont have much choice if you offer a reasonable payment plan
