eBay Listing Removed: Trademark Violation - Unauthorised Item

I've just this minute had an email from ebay telling me that a music cd I listed for sale has been removed.

I do not understand why I cannot resell a music cd. I took my own photo of the item and not a stock photo. Anyone have any idea?

It's not a big deal as I only started it at 99p and wasn't even sure if it would sell, I just wondered what I had done wrong.

Here is the email received:

"Thank you for your recent auction-style listing on eBay. Unfortunately, these items breached one or more of our policies and had to be removed from the site:

Your eBay fees for this item have been credited to your account and all bidders on this item have been notified of its removal.

The rights owner, xxxxx xxxxxx / xxxxx, notified eBay that this listing violates intellectual property rights. When eBay receives a report of
this type of violation, we remove the listing to comply with the law.

Why was your listing removed?

Trademark infringement is unlawful and breaches eBay's policies. A trademark is a unique sign (such as a name, word, phrase, logo, or symbol) that a company uses to identify its products and/or services.

Using another company's trademark in a way that may confuse buyers about the source of goods or services, or confuses buyers into believing that the seller is affiliated with, sponsored by or endorsed by the trademark owner is both illegal and against eBay's policies. Examples include counterfeits, unauthorised replica items and items that bear the brand or logo of a company without that company's permission.

Guideline: If the product you are listing bears the brand or logo of a company, but it wasn't made or authorised by that company, don't sell it on eBay.

The rights owner for the item you listed sent us a signed legal statement telling us that your item infringed their copyright, trademark or other rights. We were therefore legally obliged to remove the listing.

  • Without knowing what the CD was (I ssume tht it ws an original) it is difficult to comment.

  • It's not a Paul McKenna CD, by any chance?

    He regularly gets legitimate items removed. He has removed several of mine, misusing his VERo rights. I have tried contacting him and his agent about it, but they don't reply.

    yes it was a genuine original cd, not a copy or anything like that

    no not a paul mckenna cd, its a music cd
  • Maybe its just a one off or a mistake on ebay's part? Maybe someone reported you and they just pulled it without checking it themselves?? Try re-listing and see what happens, or maybe emailing them.

    Pink might as well tell us what it was artist label etc.
    Might help us figure it out.
    As listing has been pulled won't be appearing on ebay so noone can track down your ebay ID.

    Makes no difference. Vero is applied when someone reports a particular item, it doesn't affect other items across the board. It's like when my Dirty Dancing video got removed, pages and pages were still left showing.

    Some manufacturers do protect their items, Disney for instance often go through periods of having everything Disney removed, as do Warner Brothers.
