hi there can someone please advise me where i stand. I have a car which is in my name but the hp is in my ex partners name and up till now he has had no problem in paying it but out of spite he is now threatening to stop payments will i loose the car? it was a gift from him to me. please help as its my only form of contact with the outside world as in middle of nowhere

because i have been medically discharged from the forces and have no money and have his 4 year old son to bring up aswell!! and please before anyone starts with the benefits im entitled to i am only entitled to £15 a week because of my medical pension and i woul dhappily go out to work if i wasnt waiting for yet another operation on my ankles and in horrific pain every day x i thought perhaps i would be able to get some advice on here on where i stood legally0

If you don't have the written down then I'm not surprised he's not paying for you to run about in a car. If he couldn't afford to buy it outright in the first place chances are he now needs his own vehicle.
Why not, as above, take over the payments? Failing that, you will need to hand the car back to the finance company.
On the plus side, if it is in his name chances are it'll be his credit rating that will get screwed over not yours so you could go out and get a cheaper car for yourself.

EDIT - wrote this as you were posting. TBH you could go out and work. What's stopping you working in a call centre or other office based job? Better than £15 a week and no different to sitting about at home. Many of these places will also have shifts for parents.
You should also make sure that any cash freed up goes towards the upkeep of your son. Technically he could have reduced his maintenence payments saying the car was to help your son get about.

The finance is in your ex's name though? And you where the first owner, ie, he didn't buy it with finance and then transfer it to you?
How much is the car worth now, and how much is left to pay?

i was the first owner he had the v5 put in my name and the debt into his at time of purchse i put £2000 towards it at the time. i am unsure how much is left to pay. (original cost 10k)
as for an office job unfortunatley my medical problems not also stop me standing for long periods they also stop me sitting for long periods as i seize up and cant get back up x0 -

Yes, my partner has had over 30 operations on her legs because she was born without hip sockets.
She's currently on morphine simply to get out of bed but still works four out of five days a week supporting other disabled people.
Employers are legally bound to offer interviews to disabled people who fit the job spec and should take reasonable steps to ensure comfort.
The mrs is the person I measure most claims of pain by and a lot don't stack up. Whilst I accept the OP might have an issue I don't think sitting and waiting for an operation is a good idea. I also think if they are capable of sitting in and driving a car then they either aren't on the sleepy meds or could just as easily be sat somewhere else and working.

But people differ as how they cope with pain; some have a very low tolerance, and it is not really fait to draw conclusions from one person's undoubted courage and perserverance and apply it to everyone.I used to think that good grammar is important, but now I know that good wine is importanter.0
