Help Please.Huge Repair Bill 5 days after buying car

    I've known in the past ebay to take the hit in some buyer resolution cases -- but these are usually a case of lost in post where nobody is at fault and usually for small sums of money. I can't for a second imagine ebay taking the hit on this kind of money, and paypal aren't even a party involved in the transaction so won't do anything

    They cant tell if it needs a clutch until they take it apart, it may be OK

    I had to have a new DMF and the clutch was only half worn but i decided to get it replaced anyway

    What type of car is it ?

    Im pretty sure the dealer would have known, its a common fault on modern diesels.

    That said you can ride around for a long time with the fault,my work van needs a new DMF and the workshop don't want to repair it as its being sent to auction in a few months, i have done 30k on the noisy DMF so far

    When we collected the car we noticed a slight vibration on acceleration and pulled into the nearest garage for fuel and rang the guy to express our concerns.He said he was sure it was fine and it had been stood for a bit and is probably that and will be ok after a good run

    come on dealer has stitched them up he knows hes stitched them up and hoped they wouldnt come back
    i would be back to his place and i would get my money back i dont care if it was run by itinerants as most bomb sites are these days but i would get my money back
  • Thank you for all your advice..Left him a big fat neg on his feedback,still got loads of cars listed but pretty sure his feedback is a set up as fair few of his 'buyers' spell helpful 'helpfull'..

    Can go down small claims line but doesnt help us in the meantime with no car at all with 3 children.Just feel totally defeated by it all x
  • Just had an email from someone who did a hpi check on van he was interested in that they are selling and its come back with finance outstanding even though the listing says its clear..had a few mins panic whilst i ran one myself but its clear..think that would have really added insult to injury .

    Your whole approach throughout this thread has been negative and unhelpful and you've even tried to make it seem that the OP is crazy for even mentioning a claim on this outfit, she didn't even get home for Christ's sake before the car was having problems despite it being described as in 'excellent mechanical working order' and there's you saying the fault could be dismissed as fair wear and tear due to its mileage ie tough titties, you clown.
    It clearly was nothing of the kind and it's almost certainly the case that the dealer knew of this fault, but instead chooses to come up with some bs line that the vibration will probably disappear if it's given a good drive.
    As they are now avoiding all contact they clearly feel no obligations to the buyer, therefore the options remaining are either to go in hard through whatever means necessary or to pursue legal recourse.

    Maybe it's because i'm being negative and unhelpful... or maybe i'm being realistic. If you think the dealer won't defend the case after the poor display thus far then think again... so what's wrong with op making sure he is well prepared to completely backup and substantiate his claim and ensure the dealer can't get away with feeding the courts some technical BS about it being wear & tear or something else which op can't argue against, therefore leaving without a judgement.

    I didn't say op didn't have a case, just putting the other sidee to it. I've been to court and know people who have been to court and failed miserably because they've failed to do something as basic as provide proof of an items description for example.

    As I said in my previous post

    Before you do anything though, you need to decide what you want to get from this (bearing in mind the points i've made)... a refund or repair.

    If the former, it should have already been advised to op that the vehicle should stop being used and the dealer advised it's being rejected and available for collection. If the latter then op may be able to sort out the problems and pursue the cost of this

    You could even have it repaired and pursue the dealer for costs.

    If op wants to keep the car he could offer the dealer the opportunity to rectify it. If the dealers fails to respond op can get a few quotes, choose the lowest therefore mitigating his losses and have it repaired. If the car is misdescribed/faulty as op has suggested then if op can prove this they should be able to have a court award costs.
