Help Please.Huge Repair Bill 5 days after buying car

  • Seller is now ignoring emails and not answering his phone.Just wondered if anyone could help with what i should do next?We are stranded without a car and really upset over it..
    Just had a nosey through his feedback and alarm bells are now ringing with it..either that or a lot of his buyers cant spell Helpful properly..
  • Give him a letter before action (Google how to write one if unsure) and give him 14 days to repair the vehicle.

    Make sure you send it Recorded delivery.

    If nothing after 14 days, lodge a claim with the Small Claims Court. It'll cost about £50.

    Rejecting cars under sales of goods act aren't always that simple because of the wear and tear aspect of it.

    Exactly what faults does it have? You need to determine whether components have failed or not and whether considering the high mileague they have lasted overall for reasonable time/been of satisfactory quality...

    You can't expect a car of such age/mileague to be perfect.

    You say you took it to the garage to be looked at... so the car is still driving, just with a shudder... so what exactly is causing the shudder...

    The car may well require £1300 of repairs, but put a mechanic under a car and i'm betting they could find many parts that could need repairing/replacing even if they have not yet failed. Some of it may merely be preventative maintenance.

    There's too many posters in here getting ahead of themselves before even knowing the full facts. You may have a case, you may not - so until you know you do, don't be making rash decisions like filing court cases.

Some of it may merely be preventative maintenance.-As said above the car needs urgent repairs,not just preventative.The car was listed as being in perfect mechanical order as it clearly isn't -it has done 155 mile since we purchased it..150 of those were the journey home with it.The judder was brought to the sellers attention within minutes of us leaving with it and he said the car had been stood and a good run would sort it..clearly now it wasnt the case at all and with hindsight knowing what we do now we would have got our money back there and then and walked away.

    What's the ife expectancy of the flywheel?

    From what I read the flywheel is considered to be a wear item and generally changed at the same time as the clutch. At 80-90k miles the springs can weaken. I would add i'm not a huge car fanatic so my knowledge of it all is fairly basic, so worth checking on your specific make/model.

    But if this is the case, then the dealer could argue this is down to W&T as a result of buying a car with 80k on the clock. They could also argue the car is in good mechanical order considering its age and mileague. If you did have a case it would likely be not as described, but that may be an uphill battle, rather than on the grounds the goods are faulty (which is different to being a result of wear and tear).
    clearly now it wasnt the case at all and with hindsight knowing what we do now we would have got our money back there and then and walked away.

    Hindsights a wonderful thing, no point kicking yourself for what you should have done :)


    Before you do anything though, you need to decide what you want to get from this (bearing in mind the points i've made)... a refund or repair.

    A solid flywheel and clutch kit is less than £300. 3Hours to fit, so should cost total £700 all-in.
    A solid flywheel works just as well, but eliminates the risks off failure that come with DMFs. You do get a slight vibration through the pedal, but no more than you would get from a non-DMF diesel anyway.

  • Just had a reply from the sellers business partner,saying he is handling things at the moment but the other guy is very ill in hospital at the moment and will attempt to discuss it with him tomorrow as he is unsure which focus it is.

    Do i leave it until later tomorrow now do you think and give him chance to reply.?
    How would i enforce the sale of good act if need be?solicitor?small claims court.really dont know what i would need to do next.

    Could you put in a claim through ebay or paypal as not as described? I've read that paypal are able to refund money even though it has been paid cash on collection. Not sure if it applies to such a large purchase though.
