UKCPS Ltd Parking notice charge.

I have recently received a UKCPS Ltd parking notice charge on my car, my car was at the time parked in my private parking space in the car park to my flats, I have a valid permit for it, however it was not on display at the time as I forgot to put it back in my car after using another car (my own forgetfulness). I have read many of the threads about these parking notices, however, I am unsure as to what to do, I will always have to park in that space therefore I will be easy to find and I am worried about being clamped etc. Can anyone give any advice on this situation?

Ignore it. They were putting it on to protect your space (or rather their profits) so if the space is yours you can choose to put a parking permit on it, or not, as you please. Under no circumstances pay them so much as an old halfpenny.
They are not going to clamp you, if they clamp you on your own property you will be able to sue the landlord for employing such a bunch of morons.
If you want to mention it, do so to the landlord. Don't waste your time dealing with the PPC's phoney appeal system.0 -
I disagree with the ignore advice here. Does your lease give you the right to a space ? If so there's no obligation for you to display a permit. You should take this up with your landlord / managing agent. Potentially they are breaking the terms of your lease and become liable to you suing them.All aboard the Gus Bus !0

Just had a look at my tenancy agreement, nothing specific is mentioned with regards to a parking space. However, I do have a valid permit which is always on display apart from this one time.John Doe0

They are effectively trying to "fine" you for not displaying your permit. But they have no lawful authority to issue such a fine.
Neither do they have any lawful power to clamp your car if you do not pay this unenforceable "fine". You would be within your rights to remove the clamp if they tooks such a course of action."You should know not to believe everything in media & polls by now !"

Just ignore the whole thing and the letters that follow. In the absence of (very very rare) real sealed Small Claims paperwork then this whole thing is safe to ignore.
Certainly as long as the signs in the car park do not mention clamping and a clamp release fee. Even if they do then to clamp a car for an 'alleged made up debt' like this is not lawful, so it almost never happens and in the 2 cases I know of on other forums the posters have kicked up a fuss, legally if need be, and got their cars back pretty quick and claimed any costs/expenses from the PPC for the unlawful clamping. Certainly if the signs only mention (fake) PCNs then you can be sure that that a clamp will not happen.
If you had your own allocated space then you could have pointed out to the Managing Agent that the PPC was trespassing on your property. But as it's not allocated then all that has happened is that you have received a flyer on your windscreen asking you to part with some money. As enforceable as a Burger King leaflet suggesting you may like to buy a burger...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's common for the management company to hand over the entire land to the parking company and impose permits. If your lease grants you the rights to use the land, you are under no obligation to display proof to a third party that you are not trespassing on land you have granted rights over. This is even before the unenforceability of any charge anyway.
The parking company can only operate within communal areas.
This is why it's best to find the exact wording of the lease about parking and tell the management company and UKCPS that you reject their permit scheme and withdraw all implied access to the land to UKCPS.
This is a case of other parties trampling over the rights granted to you in your lease. You wouldn't stand for it if UKCPS came into your kitchen and attempted to fine you if your washing up wasn't up to scratch.
Post the exact text of your lease, not your tenancy agreement. Your landlord will have it, or find an owner-occupier in another flat. Do you have a Facebook page for your development?0 -
If they check the DVLA for the registered keeper its going to show the flat you are renting as the address of the vehicle, and you have a permit to park there as well, this will never reach any court as its plainly a penalty even the moron peter haswell will run a mile from this, if he doesn't then it just shows what an utter shambles UKCPS is in with this person in charge.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

Just received this email after I initially sent an email to appeal. Can anyone advise on this nonsense? Notice there's no names, how convinient. I have had to remove the name of my residence for privacy reasons, hence the ..................

.................. car park is private land and there are many signs at the site which state this and the parking restrictions in force. By parking your vehicle you contractually agree to display a valid permit or pay a parking charge of £100 (reduced to £60 for early settlement within 14 days). As a permit holder it is your responsibility to ensure that your permit is correctly displayed in the vehicle. As you failed to display a parking permit you were correctly issued with a parking notice charge which will stand.
