Car dealer gazumped me or... ?
Hi,
I would really appreciate help from you guys...
Last week on Wednesday I've agreed to buy a car from a dealer, paid deposit, signed the agreement and agreed to collect the car in a week time as the car needed some work done before the collection.
Yesterday I've called the dealer as I've not heard from them since paying the deposit for the car, they've told me the car is still in garage getting the work done.
Today, I've received a call from the dealer saying that it would be the best if I took my deposit back as the car has "some discrepancies"... ??? They've told me "as it is hybrid, something is wrong with electrics" and it will probably be the best if I take my deposit back...
When I've agreed to buy the car, I had a mechanic who checked the car and I got the report back saying that everything is fine with the car, beside few scratches on the back bumper and back windows not opening. It was agreed with the dealer they will repair windows and get rid of scratches. Now dealer is saying that car has "some discrepancies" and they would want me to take the deposit back... ????
The car was advertised as immaculate, low millage and at the price of £18.500. We've agreed that I will buy it at £18.000 and they will do the work... however, I have a terrible feeling that someone maybe offered them a full asking price and they are trying to get out of agreement with me.... do not understand why as I am cash buyer!
The car was never taken off the market after we've agreed the price and me paying deposit and signing the agreement.
I have refused to take the deposit back and agreed to call them on Friday to find out what did garage say about the repair.
Can someone please tell me where do I stand. Can the dealer just go ahead and sell it to someone else even after I've paid deposit and signed the agreement? What are my rights in all this, as I rally want this car.
Thanks! X

They would much prefer a finance buyer, the make a fortune of the finance kick back.0

I did asked them if tehy would prefer me to but with finance or cash as it was all same to me... and I was told they would prefer cash!0
-
... and I can see why is it important now what they would prefer... when the agreement has been signed and deposit paid???
Does this mean they can disregard our agreement just because someone else with finance wants to buy the same car now???0 -
You may well be correct, but what if you're not - you're proposing to try and force someone to sell you something which they state is faulty. Good luck trying to get that fixed if it goes wrong in 4 weeks time.0

What is the make and model of car and its age? Is it still under manufacturers warranty?"You should know not to believe everything in media & polls by now !"

finance would be their prefured option i dont know why they said they would want cash.
if they say there discrepancies take them at their word and get the cash deposit and not return back there, thier loss.0 -
I am not trying to force anyone to sell me anything, just trying to find out why would they want to back out of the agreement after a week and what I should do if they are backing out of the agreement just because they have a friend or someone else who is interested in buying the car and now they do not want to sell it to me.
Mechanic confirmed that everything is fine with the car, I do not understand how all of a sudden there is a "discrepancy with the car"0 -
Car is Lexus RX400 with 23.000 miles, 20060

i knew a trader used to take deposits off people and say car ready in a week
this way he let the ad run and was waiting for the highest offer
he then rang all the other deposit holders and told them a hpi check had come up bad
hes not in the business now as he was sick of getting black eyes
