i too am at my wits end with dealings with mr cohen from rundle and co. today i delivered a letter of complaint to the council . yesterday he waltzed un announced through my front door ,along my corridor and into my lounge after opening the door . I had company but that didnt stop him.he proceeded to tell me i had broken an agreement - i hadnt - and because of this he demanded i pay 200 pounds within 2 days. i get paid on thursday and if i give him 200 pounds i would have Very little left.
i have been paying 200 each month regularly to the bailiffs ( 7 payments) . during december 2011 i was told when i contacted rundle and co to make my usual 200 payment that i only had to pay 65. I was speechless, i asked the woman clerk to confirm this because i didnt want Mr Cohen anywhere near me , she confirmed it was now 65 .she even joked that he had done me a favour . I paid and that was it. that was, until yesterday when mr Cohen wandedered into my lounge and started off about breach of agreement etc, he threatened to clamp my car along with being willfully ignorant and intimidating.I ahve had dealings with this man on several occasions and despite me being easy going and meek about the whole affair and causing him no trouble at all he seems to be getting a great big kick out of being as nasty and intimidating as he can . my guest could not beleive his ears and said i was a fool to put up with it ,,i just dont know where i stand . i sent a letter to the council today (hand delivered afterwork at 5 am!) explaining my situation and asking for help and advice . they have not yet replied. i have to pay 200 by thursday feb 9th 2012 or no doubt hell be round again to clamp my car and press himself into the house and take all the goods hes listed down. Help!

I assume that this is Council Tax debt?
Did not one ever explain to you that baillifs are allowed peaceful entry, which means that they can enter throught any door or window that is not locked? You need to keep all of them locked if you are dealing with them.
And that they can levy on a car if it is outside so you make sure it is not there.
He now has a walking possession order or levy.
You need to get hold of your local councilor and to complain to Rundles about the fact that they told you one thing in December and then reacted now.

Bailiffs routinely charge illegal fees, although the reason Mr Cohen wanted to come in is more basic - he can now charge you extra fees legally.
How much do you owe?
How much is he charging in fees?
What has he listwed on the levy/WPO? And how much is the stuff worth?If you've have not made a mistake, you've made nothing0 -

the date of the notice of seizure
what goods were levied
how much you have pave paid so far to rundle &coI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

don't expect to much from your council same bailiff same council and still not certificated to rundle &co

It is very difficult to properly advise without knowing the background It is possible that you have been overcharged y this cannot be confirmed without knowing the following:
What was the amount of the Liability Order as confirmed BY THE COUNCIL...and not the bailiff!!
Was a levy made on goods and if so, what was on the levy?
What charges have been applied and when?
How much have you paid?
PS: When you call the council to ask them to confirm the amount of the Liability Order I would suggest that you ask them how much they have received from the bailiff company. You MAY be in for a shock.

Ahh dear Mr Cohen, my favorite bailiff, 1st things 1st email the council [EMAIL="Recovery@southglos.gov.uk"]Recovery@southglos.gov.uk[/EMAIL] or [EMAIL="amanda.deeks@southglos.gov.uk"]amanda.deeks@southglos.gov.uk[/EMAIL] (cheif exec of south glos) making a formal complaint against Mr Cohen and his office for their sheer lack of help and he behaviour saying you felt threaten and intimidatied by him and acting on instructions from his office via phone you made a payment of x amount then he entered your property and starting threatening you. etc.
my personal experince with him and his clerk is a complete nightmare, i have had the mispleasure of haivng to deal with his clerk on a few occasions and found her to be lacking in even the slighest customer service skills. very rude and very argumentive when on the phone.
Has Mr Cohen entered your property before this time or did he just wander in of his own accord? move your car somewhere safe but near by, so he can't come back and clamp it, so thats one worry of your mind(im sure others will advise you the same thing) as i put in my message to you, i have contacted the ministry of justice about his cert and am waiting to hear back from them, need to chase them up.
read my thread and the advice from hallowitch she is a godsend and talks alot of sense and fire off that complaint email to Mrs deeks maybe someone in their complaints team will finally twig what a $%£$^ mr cohen is and do something about it. but dont hold your breath i was fob off repeatly by them and only after badgering them did rundles agree to remove all fee's and charges.
im still not happy with the outcome but pretty much have reach a dead end with the only option left is a form 4 complaint which isnt a good idea as rundles will send their barrister/solictor to court and tear me a new one( think mr burns saying meet my lawyers) and i will be lumbered with all the cost's as its my word against his.Life and Investment Support Exec,

CODE OF PRACTICE FOR BAILIFF COMPANIES EMPLOYED BY SOUTH GLOUCESTERSHIRE COUNCIL FOR ENFORCEMENT OF LOCAL TAXATION DEBTS.
2. THE BAILIFF FIRM will ensure that all employees, contractors and agents will at all times act within the scope of current legislation (including The Human Rights Act 1998) and ensure that all notices and other documentation left with or sent to THE DEBTOR are neither ambiguous nor misleading.
3. THE BAILIFF COMPANY will ensure that all BAILIFFS, employees, contractors and agents have an appropriate knowledge and understanding of relevant legislation and powers. Where necessary, THE BAILIFF FIRM will ensure that adequate training is given
4. THE BAILIFF FIRM will be a member of the Certificated Bailiffs Association and abide by the rules and expectations of that Association.
5. BAILIFFS and employees, contractors and agents of THE BAILIFF FIRM will act in a responsible and courteous manner, and will act in the interests of SOUTH GLOUCESTERSHIRE COUNCIL at all times.
6. Representatives of THE BAILIFF FIRM must be aware that they represent SOUTH GLOUCESTERSHIRE COUNCIL in their dealings with DEBTORS and should act accordingly at all times.
7. THE BAILIFF FIRM will maintain an acceptable standard of dress among all employees, contractors and agents, consistent with the provision of a professional service.
8. All BAILIFFS carrying out the lawful act of distraint on goods shall hold a current BAILIFFS GENERAL CERTIFCIATE TO LEVY DISTRESS issued by the County Court. THE BAILIFF FIRM will ensure that the removal of goods is always directly supervised by a certificated bailiff.
9. SOUTH GLOUCESTERSHIRE COUNCIL will appoint a SUPERVISING OFFICER, who shall be a senior member of staff, to liase with BAILIFFS and the BAILIFF FIRM on all matters.
10. THE BAILIFF FIRM must establish and maintain an internal complaint procedure overseen by a senior member of staff. SOUTH GLOUCESTERSHIRE COUNCIL’S SUPERVISING OFFICER shall be responsible for ensuring that any complaints received from DEBTORS or their representatives by SOUTH GLOUCESTERSHIRE COUNCIL are handled in accordance with the COUNCIL’S own official complaints procedure. THE SUPERVISING OFFICER should be a member of any monitoring panel responsible for the satisfactory operation of the contract.
11. THE BAILIFF FIRM will bring to the attention of THE SUPERVISING OFFICER cases that are felt to be inappropriate for distraint action in accordance with the attached BAILIFF GUIDELINES and will seek authorisation before proceeding.
12. THE BAILIFF and THE BAILIFF FIRM will, on returning any un-executed Liability Orders, report the reason(s) why distraint has not taken place, together with any other additional information that is relevant. This will include Nulla Bona where appropriate and where possible employment or Benefit details.
13. THE BAILIFF and THE BAILIFF FIRM shall ensure that all information coming into their possession during the performance of the contract is treated as strictly confidential and is not to be used for any purpose other than the performance of the contract. All data must be handled in accordance with the Data Protection Acts 1994 and 1998.
14. THE BAILIFF FIRM must ensure that it’s employees use the title “Bailiff” only when carrying out appropriate work (for instance not when acting as debt collectors or tracing agents). BAILIFFS must not misrepresent their powers, qualifications, capacities, experience or abilities.
15. THE BAILIFF FIRM must declare all associated interests of companies, firms, associations and groups to SOUTH GLOUCESTERSHIRE COUNCIL.
16. THE BAILIFF FIRM will undertake to process all instructions within a period of 3 months from the date of receipt. Individual cases may be held for a longer period only if specifically agreed with THE SUPERVISING OFFICER. A full status report on all cases held should be sent through on a weekly basis.
17. THE BAILIFF FIRM will answer all correspondence from debtors within 5 working days of receipt wherever possible.
18. THE BAILIFF FIRM will account for monies and return all abortive/withdrawn instructions to SOUTH GLOUCESTERSHIRE COUNCIL promptly and in accordance with the contract.
19. THE BAILIFF FIRM must keep and properly maintain a separate client bank account in joint names (i.e. THE BAILIFF FIRM and SOUTH GLOUCESTERSHIRE COUNCIL). All cheques drawn on the account must be signed by a representative from each party. THE BAILIFF FIRM must also set up a suspense account which records all unidentified payments. THE BAILIFF FIRM must allow reasonable access for SOUTH GLOUCESTERSHIRE COUNCIL auditors to the records of these accounts.
20. THE BAILIFF FIRM will make available to SOUTH GLOUCESTERSHIRE COUNCIL, on request, all correspondence relating to DEBTORS, and any supporting documents or working papers.
21. THE BAILIFF FIRM must hold an agreed amount of professional indemnity insurance to cover acts and omissions of it’s employees, contractors and agents. THE BAILIFF FIRM will satisfy SOUTH GLOUCESTERSHIRE COUNCIL that such insurance is up to date at all times.
22. THE BAILIFF FIRM must be an equal opportunity employer.
23. Copies of the Code of Practice should be made freely available to any interested party on request.

Have compained to SGC, who completely ignored the issue, and so have just responded re-requesting the information requested and submitted a FOI request to confirm Cohen and Mitsis' authority to work on behalf of the council as employees of Revenue Services Ltd.
My kids were in the car 2 weeks ago waiting for my wife when they came and told my wife they were taking the car immediately. SGC had the cheek to ask why she "feared for the safety of the children" - idiots!0 -

I will be very surprised if the contract service level agreement Rundle&CO have allows them to subcontract
