I'm quite stunned by this thread - I know it's Dicken's 200th anniversary, but the real-life re-enactment is seriously unpalatable! I'm seriously shocked that this sort of thing can happen in this day and age.Value-for-money-for-me-puhleeze!

it seems to me that a joint meeting with your local MP might be a good thing. And perhaps another one with your local councillors? If you've have not made a mistake, you've made nothing0

i got a reply.....
Thank you foryour recent request made under the Freedom of Information Act. I have listedyour questions below and provided answers where possible.
[*]Does South Gloucestershire Council have a Service Level Agreement with Rundle & Co Ltd? There is not a separate Service Level Agreement however there are service standards contained within the terms of the contract.
[*]Does South Gloucestershire Council have a Contract of Employment with Rundle & Co Ltd? Yes, however the details of this contract are confidential.
[*]Does any contract or service level agreement between South Gloucestershire Council and Rundle & Co Ltd allow Rundle & Co Ltd to subcontract any work to other bailiff companies. The contract allows the bailiff company to sub contract work where the debtor does not reside in the South Gloucestershire area. Rundle and Co Ltd’s main offices are in Leicestershire however they operate a base in Bristol which is solely for South Gloucestershire cases.
My issue now is that although Rundle & Co operate an office in Bristol, all of the "Certificated Bailiffs" are registered with the court as "Revenue Services Ltd" not Rundle & Co.
Does this mean that they are not able to act as Certificated Bailiffs for Rundles?0 -
Ultimately it is the Council which is liable and responsible for the actions of its agent and that is the route you need to go IMHO. Enforcement fees are strictly laid down and the Council can be held liable for any overcharge. Don't waste your time with the monkeys, go for the organ-grinder. You need to get this to the Local Authority Ombudsman if this council abdictes its responsibility and won't address the issues.0

Well, we have received another letter today claiming that
1) The bailiff did not need to pass information regarding our hardship to the council because we had failed to do this earlier in the process
2) claiming that Mr Cohen was the attending bailiff when the events above occured (can anyone that has seen him confirm his appearance (skin colour, hair colour, build etc)
3) that Levy Fee and Attendance Fee CAN be charged for the same visit
I am writing one final reply before taking it to the local government ombudsman. This is beyond a joke now.0 -
So the letter went off yesterday, and seems to have stirred a bit of action at SGC Towers....
Apart from disputing that Mr C was the attending bailiff, and that a Levy and Attendance Fee could be charged for the same visit, I threw in a little gem suggesting that as the bailiffs concerned were in fact certificated by the court to their own company (not Rundles) and that Rundles are not allowed to outsource unless the debtor lives outside of SGC (which I don't), that they were not able to act on behalf of SGC in this capacity anyway!
will wait for their response!0 -
as for mr cohen apperance, black guy, tall, well built, didnt see his hair as he had a beanie hat on, but was wearing a green tie, with the light infanty badge on it( which suprised me as he was a compete t***)
also have heard back from the MOJ mr cohen can work for more than one company under his cert , without having to change it, as it covers him personally not the companyLife and Investment Support Exec,
My views are personal and are based on experience and knowledge gained from 7 years within Finanical Services0 -
Well Rundle will still have to confirm that Mr C is an employee, otherwise they are still outsourcing - which they are not allowed to do under the contract they have.
I'm still confused about Mr C, because we have had another person turn up here saying he is Mr C, and he looks very different. Did you see his ID Jayjay? I am really confused now.0
