VAT incorrectly applied

Same price at the time I purchased actually..;)... but an additional 20% discount offer no longer applies.
I await further comments regarding 'What is the point for only £4' and 'Surely your time is worth more than £4'
Well, I apologise. I thought these forums were here to help people and offer advice. Whether or not you personally think the matter was worth pursuing, it is the case that Amazon were incorrectly applying VAT on goods that qualify for an exemption. Perhaps by raising the issue on here it may highlight the fact that Amazon may be doing this in other situations and on other items.
Finally - Why leave it for 9 days before resurrecting an old thread to try and make a cheap point?0 -
Hi All
I need some advice since the discussion is on VAT
I was incorrectly charged vat on the supply & fit of a new heating system for a new build house. The vat charged was in excess of £1000.
I tried to claim the vat back from HMRC as part of the overall claim. HMRC advised that i had to go back to the heating company to get the vat back.
The heating company have been unco-operative and have not refunded the vat.
Can i take them to the small claims court?0 -

And it also sounds like a business contract, not a consumer one.0

Sounds like a self-build DIY situation....OP has submitted his claim to HMRC and they'ver rejected the part where the contractor has charged VAT on an install in a new build property.
If having shown the contractor HMRC's rejection letter and the contractor is still refusing to credit the VAT, then small claims court may be the best option.
It would have been best to ensure contractors understood the VAT rules before engaging with them, but if contractor isn't being co-operative then cannot see any other route than court as it is nothing to do with HMRC.Anger ruins joy, it steals the goodness of my mind. Forces me to say terrible things. Overcoming anger brings peace of mind, a mind without regret. If I overcome anger, I will be delightful and loved by everyone.0 -

In what way have the heating company been unco-operative?
In our dealings with self builds it has not always been obvious that the build was a self build and zero rated. It would usually be stated that the build was a reduced or zero rated project at the point of Sale. Did you tell the heating company that it was zero rated when you placed the order? Was the certificate of completion issued before or after this company fitted their heating system?
On the occasions that we have found out retrospectively we have alwys asked for written evidence of the build being accepted as New Build and then issued a the repayment of the VAT, which we could, of course offset against our VAT return for that quarter i.e. no cost to us.Always get a Qualified opinion - My qualifications are that I am OLD and GRUMPY:p:p0
