Crazy Jamie makes sense in his post...
Short story is: If your involved in a proper accident, expect the lowest payout for compo....
If your pulling a fast one like a lot of scummers do where there is no injury, then expect £10k :)
crap rule, but thats how the system works!

Someone hit my car with the wife driving, neck in a brace for a bit, etc etc.... went down PI route, first offer that came was £1200, solicitors wanted to go for a lot more, but she took the 1200 to save asking for more knowing the full cost only comes back on us (like her premuim is now more cos she got hit!, doh!)

If i were u, and u feel confident and done your own research, go for more or aim for your max. it all boils down to what can be said in court, etc vs cost, hence the early settlement offers...
    good luck!

We just need to put togethor a few words about why we think our case is worth more.
    Any good tips gratefully received.

Hard to give you any tips!

As you don't seem to want to give all the details here, you could go and see another solicitor and get their opinion on how fair the offer is in relation to the full picture of the injuries.

We can't give you any tips on what to write.
That's down to whatever the truth of the case is, and your solicitor knows that already.

If you think they're offering you the best advice, accept what they have advised you.

If you hoping to squeeze the very most the other side will pay, it's a game of bluff only you can play.

I have already made the offer of providing a rough estimate of quantum as to your wife's injuries if you provide the information I asked for in my last post. PM it to me if you don't want to post it in public. In the absence of that information no one here can help you as to how to justify that the injuries are worth £4,500 and £5,000, because there is no information so far to suggest that they are. This is not a game where you toss a coin and land on £4,500 or £5,000; you need to take active steps to determine the value of those injuries. Your solicitor has already provided you with one. If you don't like it, get a second opinion. But doing the litigation equivalent of licking your finger and sticking it in the air to see which way the wind is blowing when determining your counter offer is potentially a very dangerous game to play.

Thanks Jamie. I will send you a pm now.

I didnt want to make a big post about the injuries, as thought it would make the thread too long, and people may not trawl thru it .

Having never been involved in any type of case liek this before it is a learning curve.
The post about scammers get £10k , victims get £4k seems so true.

It's not. Just another by product of media sensationalism.

I'll have a look at your PM now.

Just to say thank you for all the replies and advice on this thread.

We were originally determined to ask for £4.5 or £5k , but the advice I have now taken from here (and my solicitor), is to ask for £4k max.
So Im just having to get used to that myself, then I have to convince my wife !
It would seem to ask for £4.5k (when they have offered £3.5k). may result in them refusing to budge at all , when my logic was that they would meet us half way if we said £4.5k.

Special thanks to Jamie for taking the time to send me a very detailed pm as well.

Just to let you know we have gone back to our solicitor saying we would accept £4.25k

Will let you know how we get on.

Still waiting for Tesco car insurance to confirm we havent lost our no-claims as well. We will be fuming beyond belief if we also suffer from that.

And here's the blood boiling truth of being hit in an accident ...your insurance goes up

Just insured my car , with my wife as a named driver, . It cost about £20 more becuase we have to state that my wife was involved in an accident, even tho the other side has settled as far as the car insurers are concerned. What a disgrace.
