Please can somebody advise me how I can get Impact Debt Collectors (acting for my Vanquis Bank debt) to stop pestering me to increase my monthly payments from £5.00 per month? Since being under the CAB payment plan, these are the only ones in my list of creditors that are not satisfied with my payments, and despite having told them numerous times that I am still on JSA and that I cannot afford to up the payments, they will not be put off.

Can they actually take me to court if I continue to just pay the £5.00 per month? Unfortunately, I have to make a fresh case to the Citizens Advice Bureau, as it has been a couple of years now since they drew up my payment plan and consequently they told me I would have to reapply to them all over again.

Please advise, as I do not want these Impact people to put me in court.

    Thanks

Tell them you can not pay anymore and advise them if they persue you will go bankrupt and then they will probably not get anything!

So they definitely won't be able to send bailiffs in? I am very worried about that.

In order for them to send the bailiffs in the following must happen

    • They would have to take you to court
    • You would have to lose
    • You would then have to default on any order to pay made by the court
    • You would have to ignore a form/letter that warns you of impending bailiff action.
Now they can send debt collectors around without any of that fuss, but the only "rights" a debt collector has on your property are their right arm and their right leg, etc. Tell them to go away, and ignore them. Debt collectors have no more powers or rights on your property than any other random caller.

They have the upper hand though, as if you default they can go straight for baliff action

Refusing to increase your payment is not in any way defaulting.

  • Its all idle threats, keep paying as you are and ignore any and all contact with them, as long as you keep to your £5 monthly agreement you're fine.

As others have said DO NOT worry about balifts, they would have to take you to court first (if your on JSA they would lose most likely), companies like this love to bully people into paying, if anyone visits you don't answer it.
