Being Pestered By Impact Debt Collectors

Please can somebody advise me how I can get Impact Debt Collectors (acting for my Vanquis Bank debt) to stop pestering me to increase my monthly payments from £5.00 per month? Since being under the CAB payment plan, these are the only ones in my list of creditors that are not satisfied with my payments, and despite having told them numerous times that I am still on JSA and that I cannot afford to up the payments, they will not be put off.
Can they actually take me to court if I continue to just pay the £5.00 per month? Unfortunately, I have to make a fresh case to the Citizens Advice Bureau, as it has been a couple of years now since they drew up my payment plan and consequently they told me I would have to reapply to them all over again.
Please advise, as I do not want these Impact people to put me in court.

They can take you to court for the debt, but they may not get more.Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Basically if you cannot pay anymore then do not pay anymore. If they do not accept this then they will have to go to ocurt.
is it reasonable and legal for them to ask for more every so often as peoples circumstances change.
if you still cannot afford to pay more then go through the motions again with CAB and sort out a plan.
once you have a plan in palce they shoudl back off as it might be considered an aggresive practice.0 -
I know of people who were taken to court by debt collectors and ended up getting LESS per month as a result, as the court determined that the person needed more money for living costs. I would have loved to have seen the debt collectors faces that day.
If you have no savings after paying all your bills, then you clearly can not afford to up your payments. You will need to apply to the CAB again to confirm your payment plan has not changed.0 -

The debt collection company is free to send anyone to your home and ask for payment. Your are free to ignore them and refuse entry.Bailiff Action???
I thought they had to get a court order to that!
Bailiff action typically requires a CCJ and they need a warrant which states the value of the debt. They can not force there way in. They can only enter "peacefully" (ie, via open doors or windows). They can not force there way past you if you open the door.
Government-style debts may be different (eg. evasion of tax, etc)0 -

If your on job seekers then the minimum you should be paying is £1.00 a month so your paying more than you should.
Let them take you to court because the judge would only make you pay a £1.00 a month anyway.
If they get a county court judgement and you failed to pay then they could ask the court to send bailiffs in.
And to be honest its pointless taking you to court when your on job seekers its a waste of money to be given a pound a month?
My wife is on income support and owes Lowell's £1400 and they threatened her with a ccj and bankruptcy and nothing has happened.
Debt collectors like to use threats because it makes their job easy

I used to be a CAB adviser, about seven years ago. So, obviously rules hae changed since then. For example if you owed a few years council tax, then it could be stacked to something like £2.30 a week if you were on benefits. Also, bailiffs are like vampires, never, ever, let them in your home because some strange quirk in the law means they can keep on coming back. Also, if you were very skint and you went to certain CABs', they would give you a voucher, so you could go to your local Methodist Church for a food hamper. Wish you well!0

why are they chasing you to up your payments when you've been on a plan with CAB?
send them a letter telling them to stop harrassing you or you will report them.
keep paying what you're paying and if they don't like it or think they can get more, then let them take you to court.
I can assure you that no baliff will be calling to your home, vanquis would have to secure a CCJ against you first and they haven't a hope in hell of doing that while you are still paying each month.
don't be intimidated, tell them that you are well aware of your rights and they'll back off0 -
As I have said above, they are entitled to periodically check if the debtor can pay more - could be every 6 months.
The debtor would then need to show why they hsoudl still be paying £5 a month - i.e they are on benefits. of course the debtor doesn't need to tell the collector anything but the collector may then decide !!!!!!!! to it, lets go to court.
Each situation needs to be considered on its specific issues though.0
