Can't obtain refund from LivingSocial

I recently tried to buy 2 theater tickets from Living Social one for me and one as a gift. The site allowed me to proceed with the transaction up to the point of paying where it only took money for one ticket. When I tried to get another one the tickets had sold out. There had not been any indication on the site that there was only one ticket left. I immediately contacted Living Social and told them that one ticket was no good to me and wanted a refund or voucher etc. They stated that they would not give me a refund as it states on their terms and conditions. Surely this amounts to being misled as a consumer?0
