Can't obtain refund from LivingSocial

    This would be OK if they really were contracted to do the work on the voucher. But if they had only contracted for 40 vouchers and the voucher site had given out 50, this voucher being the 43rd, you really would be in the wrong.

    This would be OK if they really were contracted to do the work on the voucher. But if they had only contracted for 40 vouchers and the voucher site had given out 50, this voucher being the 43rd, you really would be in the wrong.

    maybe,but the comany chose to set up the deal
    as it is the OP is the loser

    I agree that the OP is the loser. But the question is who is swindling him. The supplier may well have chosen to set up the deal FOR A LIMITED NUMBER OF INSTANCES.     And that is my point, it would be wrong to ambush a supplier with vouchers which had been fraudulently provided by the voucher provider.

    I agree that the OP is the loser. But the question is who is swindling him. The supplier may well have chosen to set up the deal FOR A LIMITED NUMBER OF INSTANCES. Any vouchers BEYOND THAT NUMBER would not be the responsibility of the supplier but would be the responsibility of the Voucher Provider, who would be acting fraudulently in selling those vouchers.

    Write to living social at their registered address and demand contact details. Failing that, small claims against living social.

    There is only a presumption that the voucher represents a contract with ovenzclean, it is far from certain that it is a fact. Whereas living social purporting to act as the agent of ovenzclean is far better established in fact.

    I purchased a chester Narrowboat hire deal for £45
    with Living Social Deals. This deal is running until the end of March. I have tried to book a saturday or sunday (I work and have a child in school). They only have a monday or a thursday left. I contacted Living social deals for a refund and they were very arrogant. They stated that as there were a couple of dates left it was tough and they would not refund. Living social say they only got £18 of the £45 and they were under contract NOT to say anything about living social. The customer care person CHARLIE, would not give me his surname or let me speak to a supervisor. They have no morals and just kept on repeating the same sentence like they were reading from a script! I have dealt with Groupon in the past and they are brilliant.
    Has anyone EVER successfully got a refund or satisfaction with LIVING SOCIAL DEALS??? I am going to donate my voucher to a worthy cause so it can be used, but wanted to warn everyone to be wary when dealing with Living Social Deals
  • I bought my hubby a voucher from Living Social for a round of golf which expires 31 March 2012. He has tried on several occasions to book a round in and they have said they are completely booked up and to contact Living Social for a refund. I have contacted Living Social who say:-

    'We're sorry, but unfortunately we are not able to extend a refund of any kind at this time. As stated in our Terms and Conditions (which can be found here: (blarblar can't post this) you may collect a refund within 5 days of your purchase, or if the participating merchant closes. '

    I replied 'I can not use my voucher bought off you in good faith, as the merchant is unable to book me in at anytime! I wasn't being picky on the date! Please refund me. I had a contract with you, which cannot be fulfilled so therefore I am due a refund. '

    They replied 'We are sorry Sarah, But as stated in the deal terms all bookings are subject to availability therefore we cannot refund you on this occasion. Have a nice day.'

    I mean 'Have a nice day' we keeping your money!! Ha! Surely this is theft? Can't something be done?

    Has anyone actually contacted trading standards about them yet to see if them saying that might fall under the unfair contract terms act?

    It is legally unfair to have a contract bind a consumer while not binding the supplier. It is unfair to have a consumer pay for a service which the supplier isnt supplying.......
