Going back to work after being off sick?

  • im off sick today and have been informed by my boss by text that i have a disciplinary hearing when i get back as this is the 3rd time in a year ive been off, the 1st 2 times i got a verbal and then a written warning

    1st time - in hospital for 3 weeks with pneumonia
    2nd time - in hospital for 4 days on oxygen due to pneumonia

    this time i have a bad cold, i could have gone in however my nose wont stop running and i'm aching all over.

    over the past 3 weeks someone has been off in our office and that illness has spread, wish people would just stay off if they are ill, but with the threat of disciplinary action, not suprised more an more people are going o work ill!!!

    thats unreal!
    one of my colleagues was off with pneumonia for 7 weeks!!!

    and she made no secret that she went to a concert and an ann summers paerty towards the end of her sickness..

    nothing was send on her return but the no one in my office has the same effect if they are off..

    if im off no landlord returns get sent, no paperwork goes out to tenants ect

    it actually makes it harder for me when i return hence i feel the sooner i get back the better for my own sake even if im unwell!!!

    are they allowed to do this? especially when two of your absenses involved hospital visits it's not like you were faking? i'd speak to a union rep type person to see what the script it? also check your terms of employment, i'll try and text mcbirnie and see if he ca giv eyou any advice, this is his type of thing xx

    How long have you been there? If over a year, get your personel records (as a last ditch pay £10 and get them through Data protection), then it's industrial tribunal time.

    there are a few points to consider here.
    1) Get a full copy of your personnel records immediately.
    2) Read your staff handbook. Some illnesses you are automatically excluded from attending work with, it should name these.
    3) Remember, not all illnesses are illnesses. The Health and Safety Executive class work related stress as an industrial injury, and advise people to fill in accident forms etc to this effect. This is just an example, there are many more. Cut fingers, headaches, nausea due to lights/noise etc, all these things should be put in an accident book and classed as work related injuries. NOT ILLNESSES. Once in the accident book, there is a legal process that then needs to be adhered to. Anyone can put an illness in the accident book and cannot be stopped under the Social Security Act of, i think, 1983. Thhis gives you far more protection if it reaches tribuanl and also means the process for dealing with this type of sittuatiion is different to a normal sickness.
    4) Do you have a union? I woould join now.
    5) Ring ACAS on 08457474747 ACAS are employment experts who can tell you what legal rights you have in these circumstances. They are very approachable.You can also use their ebsitte https://www.acas.org.uk
    6) Start preparing for your interview now. Get your records, and start making notes. I am in a hurry, but i can help further if needed.

    Anyone who is ill should not attend work. New EU laws are in the progress of being passed because they see Britain as to tough when staff are off ill. Most EU countries have less stringent rules when sick, and ultimately a healthier more productive workforce.
    The last few tribunals i've done, i noticed the tribunal were being more symapthetic if they thought you had a genuine case, i.e. an otherwise unblemished record.
    Remember everyone has rights, check out your staff handbook or sick regulations so you know exactly what is what, and never attend any interview alone over sick absence. Law states you can take a work colleague or a union rep in with you.

    dont feel bullied into going to work.tell your boss you will be back when you feel better.As we are always being told nobody is indespensible,except when we are ill of course!!!

  • us,thecat&thedebt please don't go back to work until you're 100% otherwise you'll be ill again and off again because you went back too soon. You shouldn't be getting calls from work neither as to when you'll be back, this sounds a bit like bullying to me, making you feel guilty for being off and this isn't helping your road to recovery.Why don't you phone the NHS health advice line. I'm sure they'll tell you that you shouldn't be in work then at least you can tell your boss you phoned the NHS for extra advice, it's just a bit of back up really.

    saintly I wish you the best of luck...I'm sure this is not allowed as other posters have said. For goodness sake you've been in hospital!!! It makes my blood boil. Don't let them get away with it!!!

  • Hope you do feel better in the morining, but I'd take the day off - its friday, the last day of the week, stuff can wait til Monday - you rest up and get fuller better not partially better xxx
