Crackling noise on calls.. Nokia C3/O2 purchase and top up

Hi, I'm not very technically minded so any advice would be welcome. I have a Nokia C3 mobile bought at 02 and am just out of the year's guarantee and have top up with 02. My phone is making a very loud crackling noise when I attempt to call or receive calls, making it impossible for anyone to hear properly and have to hang up. Does anyone have any idea what the problem may be? Should I take it back to 02 where I bought it or call up 02? Any idea of my consumer rights? Many thanks.

Unless it was a refurb the manufacturer's warranty is 2 years, not 1.
