    Hi sniggings, I have managed today to get the last two final settlement figures from her other creditors, 12 in total,£26k, now £15741.
    Decided to pay them off, in fact, 3 are now in the post.
    Rang and cancelled cccs phonecall and thanked them.
    Got to try and sort her Spanish affairs, and most importantly, her home she,s living in now.That one is going to be tricky, but letting sleeping dogs lie, at present, don,t want computer to say no, and her having to foreclose, like other op I read about, even though she paid it for years. Trying to get her partner off may cause BR even now.
    I appreciate everything all of you have done, this blog is invalueble.
    I will keep you updated, regarding other, it may help others,I have read hundreds of cases on here, and astounded at how many people are in the same boat.
    But for the grace of god;;;;;;
    You all deserve a medal, and from the bottom of my heart, THANKYOU ALL:A
    I think this has put the frighteners on my daughter, not to get in any more debt again.I HOPE.:T

    Hi Guys. an UPDATE;
    I have bitten the bullet and settled all my daughters unsecured debts that are showing on all 3 credit reference agencies;
    Now the fun begins; Her partner has told her he is definitely going to live in Spain; She is going out, to try and remove her name off the mortgaged property, and salvage something from the payed for one, and remove her name from that too;
    However, her partner is clever, and not to be trusted;;;
    Is there any way we can find out if he has any secured loan/s on the house here that we don,t know of ?
    I have a feeling he is going to remortgage the payed for property in spain to pay my daughter off, (minimum possible), and still let it to his friend, without my daughter knowing;;;
    He has obtained loans etc in aliases before, even his brothers/fathers, so nothing is beyond him;
    There is a small amount of equity in the property here, been vaued this week, and he is still on as mortgagee/joint.
    Any advice would be very much appreciated.
    I don,t want solicitors involved if possible, trying to be one step ahead of him. He will always have a BI in this property, until we get it removed somehow.
    PS Should I really be posting on this thread still as I have decided against BR??? If not I apologise , and which thread would you suggest ??:beer:

    What a lovely father, i wished id have told my family before hand as would have assisted oppossed to me going BR. BR can work for many but it can also bring a host of issues in the future.

    Hi sundays. Thankyou, very kind. I just wish she had told me earlier, as my wife and I knew it would end this way. The only person who couldn,t/wouldn,t was my daughter.
    Better late than never though. :beer:

    UPDATE:
    Hi Guys, thought I would update you and ask for a bit more advice please.
    I have settled all my daughters debts, received letters of receipt, applied to land registry to lift the second charge which was due to be put on the house, and sent a letter to the court to tell them her ccj has been settled in full, and can they take that charge off.
    Paid the fee £15.
    Now, as I predicted, her other half is getting nasty.
    Can someone tell me how she takes her name off a joint account with santander with him,she,s opened a coop a/c in her name only.
    He has said he would go to the bank, but I want my daughter to pre-empt him and go first, so he doesnt say he,s done it,and run more debts up in her name, before going to spain;
    Does she ask for a form to take HER name off, leave the a/c in his name only. she cannot close it can she?
    Need to take it one step at a time, any advice would be truly grateful. Don,t want solicitors invlolved.
    If this is not applicable to this thread, now, I will willingly go to another,if someone can tell me which?

    As far as I am aware, she should be able to remove her name from the joint account but only as long as it is in credit. If the balance is in debt then they are once again jointly liable and the bank won't remove either name.
    When I joined, I needed a name. The forum members gave one to me...I am INAN :D

    Hi Inan, thanks for reply. He wants the a/c to himself as he can use when in spain, and they have 2 joint spanish a/c,s which she wants dissasociating from.
    He,s being arkward, wants to come and go as he pleases.
    It,s in credit, as are the spanish bank a/cs.
    We just at present want to stop him running any more debts up, which leaves her liable for, now I,ve cleared everthing, which he does not know::;
    He thinks she is still thinking of BR, which he is bothered about.
    I will get her to go to the bank and request to be disassocciated from it, but all the DD,s are from it, some in his, some in hers.
    She cannot transfer his to her coop, although she has to pay them all.
    She wants independance, but isn,t going to get it, if he has anything to do with it.

    If any of 'his' DDs are for the house she lives in then all she has to do is cancel them before removing her name from the account. Then she'll need to contact the relevant utility provider and tell them she is now living alone in the house and responsible for the bills.

    Is she going to change the locks on the house so he is unable to 'come and go as he pleases' and use her home as a free hotel? If she is going to be paying the mortgage and all the bills on the house then I'd say he has no right to keys to the front door. If she wants to let him stay at any time then he should respect her and let her know when he expects to arrive and how long he plans to stay!

  • If he is owner of the house then she cannot change the locks and keep him out I am fairly sure. I really think it might be worth getting some proffesional advice on this issue.
