Hi, I wiped out all her living expenses and these are the 3 cccs say she can curtail,even though they say she is now £465 above her income.no car,no house insurance, not even building;;;;;;;with mortgage;
no hair, nothing at all.
Food, toiletries, cleaning £200 As little as possible
Clothing and footwear £15 As little as possible
Telephone, mobile and Internet £60 As little as possible
As there is £275 for these 3 items left, if she wiped all these 3 out, didn,t eat/use phone/internet and didn,t buy any footware, she would still be £200 above her means.
That to me as a layman means you are insolvent;;;0 -
I used CCCS in 2009 and it was a phone call where they gave advice on my options and I was pointed in the way of BR as they like the person themselves to choose whats good for them.
It now seems CCCS are doing things differently,some people have said CCCS were not too helpfull on the BR side and were pushing people to debt managerment methods.
If you have enough info now to know BR is right for your daught then you an go ahead or if still unsure CAD might be a better source of help for you.0 -

Please don't advise to just 'go ahead'. If a Judge asks "have you taken appropriate advice?" they may not award a BR Order if the answer is "yes, I asked some questions on the MSE BR forum".
They want to know a professional debt advisor has been through all the finances and the potential BR is fully aware of the implications of going BR.
Here in MSE we never see the full picture so cannot recommend BR based on what we do see, only suggest it may be an option and support members through the process once they have taken appropriate advice.When I joined, I needed a name. The forum members gave one to me...I am INAN

BR is a new start,some debts payents can not be wiped clear but in general it would be those that the BR person chooses to pay such as a mortgage or a loan against a mortgage but in gerneral yes it's a clean slate,there might be a payment plan set up called a IPA if she has income left over afer living expenses,then she would pay a % of her excess icome for 3 years but no IPA if her income just covers her expenses,the expenses allowed are faily reasonable as its a new start so don't think she will be on bread and water.

She has a ccj for £2500 from 2009 at northampton court. It doesn,t state what for/whom/anything other than the case number. How can I find out what it,s for?etc It,s on her credit report.equifax states a credit card is still default, callcredit said balance 0. should I get 1 from experian also?0 -
callcredit is the baby one of the 3,the other two are the 2 main ones that are used,not sure but I would think a phone to the court will either tell you from the case number or they will point you in the right direction,thing is these debts can get passed to different people all the time and with that the amounts increase like crazy and once they hear you are going BR again they seem to stick a few more 000 on the end so don't be too worried keeping tack,the main thing is if you have a list of the main creditors where the loan started out from and a best guess what the balance is then that should be good enough,it was for me and the OR took it from there.0

Bankruptcy covers all unsecured debts, so does not cover mortgage or secured loans.
If, however, the property is then returned to the mortgage company at a later date, once the property is sold any shortfall becomes unsecured and would be included in BR (just don't sign any deed of acknowledgment!)0
