o2 contract

Hello everyone, i am new to this but really need some advice

I got a laptop with a dongle 2 years ago, the laptop broke so i took it the o2 shop and she told me the contract was due to run out the next month. I presumed the contact had ended I was looking through my bank statement and noticed it is still coming out, I rang o2 who said that the contact had ended but they put a rolling month contract on therefore im still getting charged.
I am so angry it hasnt been used for about 6 months and when i asked if he could see i havent been using it he said they could see this but kept stating terms and conditions at me. I cant believe that they dont send a letter when the contract has ended asking if you would like to continue with the month rolling contract .
Is there anything i can do to recieve the money that they have been taking out??

    Nothing by "right".

    They have you by the contract terms - it wasn't a 12 month (or whatever the length was) contract at all, but a 12 month minimum term contract.

    Make sure you cancel it properly now by giving the appropriate notice, and make sure they confirm back to you they have your cancellation instructions.

    I have cancelled it with them they said they will have to take 1 more payment, just to rub salt in the wound.
    Do you think there would be any way of getting the money back that they have taken?

    No, because they have done nothing wrong. Telcoms contracts are not finite, they always roll on to 30 days contracts after the expiry of the minimum term.
    They are taking one more payment, not to 'rub salt in the wound', but because you are required to give them 30 days notice.
    It's your job to cancel after the end of the minimum term if you wish. But how come you didn't cancel the DD when you thought the contract had ended-nor check your bank statement in the last 5 months?
    No free lunch, and no free laptop ;)
  • I have 2 o2 contracts and didnt realise that it was still coming out. I just presumed that it would automatically cancel when the contract ended not rollover!
    Lesson learned i suppose

    'Fraid so. It's just like your mobile contract-after the minimum term it becomes a 30 day rolling contract.

    I've recently set up Broadband with O2 (following a link on here) and it's a very good 12 month deal. However, on initial contact i was told, after questioning why the connection fee, that i probably would not be charged it. If i was to be charged it they would contact me to see if i still wanted to go ahead. I heard nothing then received the first bill with the connection charge. I see now that they were just fobbing me off. I could complain etc but havn't the time so instead at the end of the contract i'll cease to use O2 for both my internet and mobile. I guess what i'm trying to add to this thread is that O2 is a !!!! company.

    Why let it lie? In your shoes I'd call them up and say there's been a mistake as you were told the fee would not be applied unless you were told otherwise. Worth a punt, cenrtainly.
