iPhone 3gs Insurance

I have a 2 year old iPhone 3gs. the phone still works well, although battery life has decreased significantly and the screen has a crack.
Seeing as I have been paying £12 a month for over 24 months worth of contract for insurance, I feel that I am entitled to a new handset with better battery life and a clear screen.
Oh I'm with Orange by the way.
If I ring Orange and tell them about the crack, will they give me a new handset or will they offer to fix the screen?
Is there an easy legal way to ensure that I get a new handset?

The replacement product will wherever possible be of the same or similar specification at Our discretion. The replacement may be from refurbished stock that has been tested and is fully functional.
BTW, "What is not covered" section is pretty long and includes:...
Any Incident involving Loss, Damage, Mechanical or Electrical Breakdown that results in a claim for Your Mobile Device and You do not report it to Us within 48 hours of discovery.

Is that the iPhone specific insurance? or just orange in general?0

What I quoted was "Orange Care General Terms and Conditions". You know better what you are paying for.0

Plus, it's well documented and well known that you get the best out of mobile phone batteries in the first 12 months, after that they start to deteriorate.
You've got no grounds for a claim judging from Oranges T&C's, unless you tell them your screen had just cracked which would be insurance fraud.0 -

Most Insurance are waste of time you would have been better off putting 12 month away into a savings accont and you could have bought an iphone 4 off eba as even when they do replace phones they will only give you a refurb its all down to the terms and all terms normley exclude a brand new phone.0 -

Keep the old phone and don't pay £12 for insurance a month.
Put the £12 in a seperate account then if your new phone becomes unusable for any reason you have your old one and some money.0 -

Orange care is Orange care
they charge twice as much for Iphones0 -
I have insurance through carphone warehouse, and mine is £8pm. It covers everything- even water damage. The downside to insurance though is obviously the excess- it could be a lot, but obviously cheaper than a new iPhone. The carphone warehouse will give me a phone while mine is being repaired (they will always attempt a repair before replacement I find) with a deposit of £25.
I used to get it through my bank account (i swopped banks)- are you sure you don't get it through yours?
Surely your upgrade will be up soon and you could just replace it that way. In fact, im sure iPhone contracts are 24 months.
Go into store and see if you can get an upgrade. You might aswell.0
